As used in this chapter, the following terms shall have the meanings indicated:
DRIVEWAYS
A passageway for vehicles used for ingress and egress from a lot or portion thereof to and from any road or highway located in the boundaries of Independence Township, Beaver County.
PERSON
Any individual, firm, trust, partnership, public or private association or corporation, or other legal entity.
A. 
Permits required. It shall be unlawful for any person to construct, alter, maintain, or extend any driveway within the boundaries of Independence Township, Beaver County, unless he holds a valid permit issued by the Board of Supervisors of Independence Township, Beaver County, in the name of such person for the specific construction, alteration or extension proposed.
B. 
Application to Independence Township. Each application shall be filed with the Independence Township Inspector and shall include a schematic drawing indicating the location and elevation of the proposed driveway.
C. 
Inspection and issuance of permits. Upon receipt of such application and prior to the commencement of construction, the Township Inspector shall preliminarily inspect the applicant's proposed driveway to determine initial compliance with the provisions of this chapter. After favorable determination as to the initial inspection, the applicant may commence construction. Prior to full completion, topping, and finishing of the applicant's driveway, the Township Inspector shall make a second inspection to ensure full compliance with the provisions of this chapter. After favorable determination as to this final inspection, the Township Inspector shall issue a driveway permit to applicant which shall be valid for the purpose of effecting the proposed construction, alteration or extension.

D. 
Expiration of permit. All permits issued pursuant to this chapter shall be valid only for the duration of the proposed construction, alteration or extension of the driveway. Any dispute as to the factual conclusion of completion shall be determined by the Township Inspector after an opportunity to speak and be heard is given to any interested party.
E. 
Fees. Each application for permit hereunder shall be accompanied by an inspection fee in an amount as set from time to time by resolution of the Board of Supervisors. In the event that the Township Inspector is required to perform additional or unusual service in determining said application, the cost of such additional service shall be borne by the applicant. Such charges shall be levied whether or not the application is approved.

F. 
Limited applicability to existing driveways. Driveways in existence upon the effective date of this chapter shall be required to meet the standards prescribed herein only if the presently existing driveway is sought to be altered, or extended and such alteration or extension will occur adjacent to or border any road or highway within the boundaries of Independence Township, Beaver County.

Any person who violates any provision of this chapter or any regulation adopted pursuant thereto, including failure to obtain a final inspection, shall be subject to the appropriate penalties set forth in Chapter 1, General Provisions, Article II. Notice to the offender shall not be necessary in order to constitute an offense.
