No person shall construct, alter or repair any sidewalk or curbing in any public street of the Township without first procuring a permit from the Township to do so.
Any permit obtained as required by § 185-9 shall be good for a period of two months from the date of issuance, provided that upon good cause shown, the permit may be extended for a reasonable time to complete the work.
Any permit obtained as required by § 185-9 shall be valid only to construct, alter or repair a curb and/or sidewalk pursuant to the line and grade which shall be established by the Township Engineer.

No person shall construct, alter or repair a sidewalk and/or curb, nor shall the owner of the lot fronting thereon permit the same to be done, unless the sidewalk and/or curb conforms to the grade established by the Township Engineer and is of the width and in the location fixed by the Township. The Township may require a grade certificate from a licensed engineer evidencing the finished grade of the area affected by the work.

Upon completion of the construction, alteration or repair of a sidewalk and/or curb, the person constructing, altering or repairing the same, or the owner of the lot fronting thereon, shall contact the Township within seven calendar days for the inspection of the sidewalk and/or curb by the Township. Upon inspection by the Township, the Township will issue written documentation as to whether or not the sidewalk and curb are found to conform with both the Township construction specifications and the Township Property Maintenance Code. The Township shall keep permanent records of all issued and completed permits.

All construction must be in accordance with specifications as may from time to time be established by proper Township authorities and placed on file in the Township office.

Any person receiving a permit under the provisions of this article for the construction of a sidewalk and/or curbing shall save and hold harmless the Township from any and all claims whatsoever against adjoining property owners which could, may, or have arisen as a result of the issuance of the permit or any inspection.

Any person who receives a permit under the provisions of this article for the construction of a sidewalk and/or curbing recognizes that it is his sole responsibility to provide for differentials in line and grade with that of the adjoining owners, when the established line and grade shall not be in conformity with that of the existing lines and grades.
The township shall establish such fees and charges for permits, inspections and grades as the township may from time to time determine.

This article shall be enforced by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person who violates or permits the violation of this article shall, upon conviction in a summary proceeding, be punishable by a fine of not less than $100 nor more than $1,000 or by imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense. Each section of this article that is violated shall also constitute a separate offense.
