The Board hereby approves the Joint Municipal
Agreement for Law Enforcement Services between the Township of Potter,
Beaver County, Pennsylvania (Potter) and the Township of Center, Beaver
County, Pennsylvania (Center) dated June 10, 1999, (Joint Municipal
Agreement) for the performance of Law Enforcement Services by Center
to Potter, a copy of which is attached hereto and made a part hereof.
The Board hereby finds and determines the following
particulars relating to the Joint Municipal Agreement:
A. The conditions for the Center Police Department to
provide law enforcement services to Potter are completely detailed
in the Joint Municipal Agreement, which conditions are incorporated
herein by reference.
B. The duration of the Joint Municipal Agreement is perpetual
with an initial term of three years and provision for perpetual automatic
continuation of six-month periods until terminated by either the Potter
Board or the Center Board as more particularly detailed in the Joint
Municipal Agreement.
C. The purposes and objectives of the Joint Municipal
Agreement are for the Center Police Department to provide and to be
clothed with authority to provide complete and total law enforcement
services to Potter 24 hours per day, 365 days per year for the duration
of the Joint Municipal Agreement as more particularly detailed in
the Joint Municipal Agreement.
D. The extent of financing the Joint Municipal Agreement
is the general taxing power of Potter, and the manner of financing
the Joint Municipal Agreement is for the Board to appropriate sufficient
funds in the annual Potter budget to pay the Center Board for the
law enforcement services as more particularly detailed in the Joint
Municipal Agreement.
E. No real property owned by Potter shall be transferred
to Center; and Center shall have an option to purchase the personal
property of Potter which the Board determines is not necessary or
appropriate to maintain for performance of its other governmental
services as more particularly detailed in the Joint Municipal Agreement.
The Board hereby authorizes any future amendments
to the Joint Municipal Agreement for Law Enforcement Services to be
authorized and approved by resolution of the Board.
