The Township Committee of the Township of Mansfield
finds that the transportation, possession and storage of radioactive
materials within the Township of Mansfield will negatively impact
the residents of the Township of Mansfield, their health and well-being;
impact the economic viability of the Township negatively by discouraging
residential and commercial development within the municipality; negatively
impact the value of properties within the Township of Mansfield; negatively
impact the environment, wildlife and water resources within the Township
of Mansfield.
As used in this chapter, the following terms
shall have the meanings indicated:
RADIOACTIVE MATERIALS
Includes any low-level radioactive waste as defined in N.J.S.A.
13:1E-177 et seq., or any classification of radioactive materials
in concentrations greater than low-level radioactive waste.
The development, production, storage, deployment,
usage, land filling, fabrication, destruction and transportation of
radioactive materials within the Township of Mansfield is hereby prohibited,
with the following exceptions:
A. Consumer products in general use, such as smoke detectors,
timepieces, microwave ovens, television sets, radar detectors and
such similar commonly available items of consumer use are not regulated
by this chapter.
B. Transportation of radioactive materials as regulated
by N.J.S.A. 26:2D-1 et. seq., are not regulated by this chapter, provided
such transportation has been approved in accordance with law.
C. Naturally occurring radon gas in its natural state.
Violations of the provisions of this chapter shall be punishable as provided in §
1-17 of the Code of the Township of Mansfield.
