The Board of Township Commissioners of Whitehall
Township, Lehigh County, Commonwealth of Pennsylvania, did, in 1947,
organize an Authority for the said Township, pursuant to the provisions
of the Act of May 2, 1945, P.L. 382, as amended, for the purposes
specified in said Act.

The name of the Authority shall be the Whitehall
Township Authority.
The Board of Township Commissioners of Whitehall
Township, Lehigh County, Pennsylvania, shall, at a meeting held not
later than one month prior to January 1 in each year in which a vacancy
occurs on the Board of said Authority, appoint as a member of the
Board a citizen of Whitehall Township to succeed the member whose
term expires on January 1, of the next succeeding year.

The authorized officers of the Board of Commissioners
did execute and deliver Articles of Incorporation of said Whitehall
Township Authority, which articles may not be amended without the
express approval of a majority of the Township Board of Commissioners.
A. The Charter of the Whitehall Township Authority is
extended to August 1, 2038.

The Whitehall Township Authority shall have
all the powers granted by the Act of May 2, 1945, P.L. 382, as amended,
except as otherwise set forth in this Administrative Code or the terms
of the Articles of Incorporation.

A. The Whitehall Township Authority shall confine its
operations and legal jurisdiction to the construction, operation,
maintenance, establishment, and service of water systems and water
to the residents of the Township of Whitehall or such other legal
municipal entities with which the Whitehall Township Authority and
the other governmental entity shall execute a written agreement setting
forth the terms and conditions of service. Each such contract in a
new municipal entity (i.e., Township or borough) must be approved
by resolution by the Whitehall Township Board of Commissioners prior
to becoming effective.
B. Once a new municipal entity is being served by the
Whitehall Township Authority under an approved municipal contract,
new project contracts for expansion shall require formal review and
approval of the Whitehall Township Board of Commissioners only if
the expansion will service more than 20 new equivalent dwelling units
within a three-year period.
C. The Whitehall Township Authority shall continue to
file reports and keep the Whitehall Township Board of Commissioners
advised of new projects and lines undertaken by the Whitehall Township
Authority and the Whitehall Township Authority shall be responsible
for compliance with any other law, statute or regulation governing
water service authorities operating cross municipal boundaries.

The Whitehall Township Authority shall no longer
have any power or authority to undertake any sewer projects and shall
not have the power or authority to make any extensions of any existing
sewer facilities.
