The owners of all lands having frontage on Village,
county or state highways within the Village of Woodbury, except lands
within the Palisades Interstate Park and United States Military Reservation,
shall, pursuant to § 4-412 of the Village Law, remove from
such lands all rubbish and shall refrain from depositing rubbish on
any portion of their lands which is visible from a public
highway. If any such landowner shall fail to remove such rubbish,
the Code Enforcement Officer shall serve upon him either personally
or by certified mail a notice requiring him to do so. If, within the
time stated in the notice, the rubbish shall not be removed, the Highway
Department shall remove such rubbish and the costs thereof shall be
assessed by the Village Board against the real property from which
such rubbish was removed and shall constitute a lien and charge on
said real property until paid or otherwise satisfied or discharged
and shall be collected in the same manner and at the same time as
other Village charges. The foregoing provision shall not apply to
any lands lying within the bounds of state or county highways.
Dumping of garbage, trash, refuse or rubbish
or other waste or discarded material on any lands within the Village
is hereby prohibited, except at a public dump operated by the Village
of Woodbury or a private dump operated under a special permit of the
Zoning Board of Appeals, which shall grant such permit after a public
hearing when, in its judgment, the public convenience, safety and
welfare will be substantially served and the appropriate use of neighboring
properties will not be injured thereby, and subject to such conditions
and safeguards as may be imposed by the Board to carry out the foregoing
objectives.
Littering or the deposit of any dirt, filth,
waste or rubbish in any street, highway, sidewalk or public place
is hereby prohibited. The Superintendent of Highways shall erect signs
on all public highways within the Village warning motorists that littering
is prohibited and stating the maximum penalty for violation of this
section.
Any person committing an offense against any
provision of this article shall, upon conviction, be guilty of a violation
pursuant to the Penal Law of the State of New York, punishable by
a fine not to exceed $1,000 or by imprisonment for a term not exceeding
15 days, or by both such fine and imprisonment. The continuance of
an offense for each day (24 hours) shall be deemed a distinct and
separate violation.
