It shall be unlawful for anyone to organize,
hold, or participate in a parade or procession of any kind unless
a permit has been issued for the parade or procession.
Approval of the permit shall be granted in the
sole discretion of the Township's Board of Supervisors at a regularly
scheduled meeting. In considering the application, the Board of Supervisors
shall consider the special needs of the applicant as set forth in
the application or as shall be determined to be required. As part
of any approval, the Board of Supervisors shall fix the date, time,
duration, and route of the parade or procession, which shall be set
forth in the permit.
The sponsor shall be responsible for all costs
associated with the parade or procession, including, but not limited
to, police and fire protection, damage to persons and property, and
cleanup. The Board of Supervisors shall have the option to waive any
and all of those costs in their sole discretion.
As a condition of issuing the permit, unless
waived by them in their sole discretion, the Board of Supervisors
shall require the sponsor to obtain liability insurance and/or post
a surety bond to cover the costs of police and fire protection, personal
injury to participants, spectators and bystanders, damage to property,
including Township property, and cleanup. The liability insurance
and/or security bond shall be in such amount as the Board of Supervisors
reasonably believes to be necessary to cover the anticipated costs
and liability. Such liability insurance and/or surety bond shall be
provided by no later than the meeting of the Board of Supervisors
immediately before the scheduled date of the event, and shall be posted
to the satisfaction of the Township before the permit is issued.
Any person violating any of the terms of this chapter shall, upon conviction before a Magisterial District Judge of such violation in a summary proceeding, be subject to a fine not to exceed $1,000, together with all costs as permitted by law, or, in the event of failure to pay such fine, imprisonment in the York County Prison for a term not to exceed 90 days. As used in this section, the term "person" shall mean any individual, partnership, association, corporation, sponsor, or officer or principal of a sponsor named in or designated by the permit as set forth in §
151-2A(1).
