As used in this chapter, the following terms shall have the
meanings indicated:
- PUBLIC PLACES, VILLAGE LANDS
- Any lands, roads, streets, highways, alleys, sidewalks, drives or park facilities located within the boundaries of the Incorporated Village of Montgomery, Orange County, State of New York.
- VILLAGE
- All lands, areas etc. located within the boundaries of the Incorporated Village of Montgomery, Orange County, State of New York, whether privately or publicly owned.
No person shall indulge in disorderly or noisy or disturbing
conduct within the village. Any person who commits any of the acts
in the following subsections will be considered in violation of this
chapter.
A.
Offensive language. Uses or indulges in offensive, disorderly, threatening,
abusive or insulting language, conduct or behavior.
B.
Disorderliness. Acts in such manner as to annoy, disturb, interfere
with, obstruct or be offensive to others, or cause such conditions
etc. as to require any request for police service.
C.
Causing crowd to collect. By his actions causes a crowd to collect,
except when lawfully addressing such a crowd.
D.
Missiles. Propel, throw or shoot any missile or solid object such
as stones, eggs, snowballs, sticks, metal, bullets or similar materials
upon or across or toward any street, sidewalk, highway or other public
place in the village where such act would, in fact or potentially,
injure or threaten injury to any person or property.
E.
Lewd acts and gestures. Commit or indulge in any lewd, wanton, indecent,
immodest, obscene or filthy act or gesture, or expose, display, post,
exhibit, paint, print or mark upon any wall or object or place any
placard, poster, bill, painting or sign, either as an advertisement
or otherwise, upon any building, billboard, wall, fence, tree or other
surface so as to be visible from any street or public place, which
shall be of a lewd, indecent, immodest, immoral or vulgar character
and as may be calculated to shock the sense of decency and propriety.
No person or persons shall play baseball, frisbee or any other
game or games which require the throwing or hitting of missiles between
participants or against walls, fences, buildings etc. upon any village
lands or public places with the exception of those areas specifically
designed and intended for such play.
No person or persons shall deface, damage or remove, without
permission of the owner thereof, any flowers, shrubs, trees, fence,
building, awning, sign, fountain or ornamental thing, utility pole,
street lamp or wires or conduit connected therefore, notice or handbill
lawfully posted, fire hydrant, trash baskets, flagpoles, plaques or
any other property of any kind, whether located upon public or private
property within the village.
No person or persons shall congregate, stand, loaf or loiter
upon any street, sidewalk, entrance to building or other area so as
to obstruct same, hinder or prevent persons passing or attempting
or desiring to pass thereon; nor shall they congregate, stand, loaf
or loiter in such a manner so as to annoy, disturb, inconvenience,
alarm or be offensive to others.
No person or persons shall use or cause to be used a sound truck,
mechanical sound-amplifying device, car-auto stereo, tape player,
radio or other such sound-producing device in such a manner to be
audible from said device to a point 50 feet from such device nor shall
such a device etc. create any unreasonably loud, harsh or prolonged
sound.
No person or persons shall enter without authority or trespass
upon or damage any private property or property owned by or under
the control of the village.
No person or persons shall build, kindle or assist in building
or kindling any bonfire or other fire in any street, public place
or upon any village lands without written permission of the Mayor
or the Village Board of Trustees, nor shall any person or persons
build, kindle, or assist in building or kindling any bonfire or other
fire in any place where or whereby any person or property may be injured
or endangered.
The violation of any provision of this chapter shall be punishable
by a fine not exceeding $250 or by imprisonment for not more than
15 days, or both such fine and imprisonment.
