No person
who owns, possesses, harbors or controls a dog, cat or other animal
shall cause, suffer, permit or allow such dog, cat or other animal
to soil, deface, defecate, urinate or otherwise commit a nuisance
on:
Any public highway, street or road or any public
thoroughfare or walkway or on any other public property or any place
used by the public, except that dogs, cats and other domestic animals
may be permitted to urinate or defecate on that portion of a public
highway or road between the curblines if any such feces or other solid
materials so deposited by such dog, cat or other domestic animal are
immediately removed and disposed of in a safe and sanitary manner.
Any private property, other than the property
occupied by the owner, possessor, harborer or controller of such dog,
cat or other animal, without the consent of the occupant thereof.
It shall be presumed that an animal defecating, urinating or committing
a nuisance on private property of a person other than the animal's
owner or possessor does so without the consent of the owner or person
in possession of such private property.
It shall be unlawful for a dog or other animal to
chase, jump upon or at, or otherwise harass any person in such manner
as to reasonably cause intimidation or fear by such person or to put
such person in reasonable apprehension of bodily harm or injury. A
person owning or possessing a dog or other animal committing an act
prohibited herein, with or without the knowledge, consent or fault
of such person, shall be guilty of violation of this article.
Any person committing an offense against any provision of this article shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Article I, Penalties and Assessments, of the Code of the Village of Plandome Manor.
