As per Article 8 of the Environmental Conservation
Law and the implementing regulations 6 NYCRR Part 617, an examination
to review the impacts on the environment of a discretionary decision
by a reviewing agency (Planning Board, Board of Zoning Appeals and/or
Board of Trustees of the Village of Plandome Manor) may be required
prior to the reviewing agency's making of a decision.
The reviewing agency which has primary responsibility
for review shall declare itself the lead agency for purposes of environmental
review.
The reviewing agency shall require the applicant
to complete either a short or full environmental assessment form (EAF)
to provide basic information about the proposed development and to
assist the agency in making a determination of significance.
On the basis of an EAF, the lead agency shall
determine which one of the following categories the action fits:
A. Excluded: that the action taken is subject to review
under the Public Service Commission.
B. Exempt: that the action is a ministerial action or
another narrow action which is exempt from review.
C. Type II: that the action meets or exceeds thresholds
listed in the above-referenced regulations which will require the
preparation of an environmental impact statement.
D. Unlisted: that the action is not included in one of
the above categories and will require a lesser degree of documentation
but will still require a determination of significance.
