Every person convicted of a traffic infraction
for a violation of any provision of this chapter which is not charged
in a violation of any provision of the Vehicle and Traffic Law of
the State of New York shall, for a first conviction thereof, be punished
by a fine of $100 or by imprisonment of 15 days, or by both such fine
and imprisonment. For a second such conviction within 18 months thereafter,
such person shall be punished by a fine of $200 or by imprisonment
of 45 days, or by both such fine and imprisonment. Upon a third subsequent
conviction within 18 months after the first conviction, such person
shall be punished by a fine of $300 or imprisonment of 90 days, or
by both such fine and imprisonment.
If any article, section, subsection, paragraph,
sentence, clause or provision of this chapter shall be adjudged by
any court of competent jurisdiction to be invalid, such adjudication
shall not affect, impair or invalidate the remainder thereof but shall
be confined in its operation to the article, section, subsection,
paragraph, sentence, clause or provision thereof directly involved
in the controversy in which such judgment shall have been rendered.
All prior ordinances, regulations and rules
or parts of such of this Village regulating traffic and parking are
hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed,
in violation of any ordinance, regulation or rule hereby repealed,
prior to the taking effect of this chapter.
