This chapter shall be entitled "An ordinance
to limit and restrict to specified districts or zones, and to regulate
therein, buildings and structures according to their construction
and the nature and extent of their use, and the nature and extent
of the uses of land in the Borough of Danville, and providing for
the administration and enforcement of the provisions herein contained
and fixing penalties for the violation thereof."
This chapter shall be known and may be cited
as the "Danville Borough Zoning Ordinance."
These regulations are deemed necessary to achieve
the following purposes:
A. To promote, protect and facilitate any or all of the
following: the public health, safety, morals and the general welfare;
coordinated and practical community development and proper density
of population; emergency management preparedness and operations, airports
and national defense facilities; the provision of adequate light and
air; access to incident solar energy; police protection; vehicle parking
and loading space; transportation; water; sewerage; schools; recreation
facilities; public grounds; the provision of a safe, reliable and
adequate water supply for domestic, commercial or industrial use and
other public requirements; as well as preservation of the natural,
scenic and historic values in the environment and preservation of
forests, wetlands, aquifers and floodplains.
B. To prevent one or more of the following: overcrowding
of land, blight, danger and congestion in travel and transportation,
loss of health, life or property from fire, flood, panic or other
dangers.
C. To provide for the use of land within the municipality
for residential housing of various dwelling types encompassing all
basic forms of housing, including single-family and two-family dwellings
and a reasonable range of multifamily dwellings in various arrangements.
D. To accommodate reasonable overall community growth,
including population and employment growth, and opportunities for
development of a variety of residential dwelling types and nonresidential
uses.
E. To adopt and enforce effective land use controls in
areas subject to flooding in order to prevent the loss of property
and life, the creation of health and safety hazards, the disruption
of commerce and governmental services, the extraordinary and unnecessary
expenditure of public funds for flood protection and relief and the
impairment of the tax base by:
(1) Regulating uses, activities and development which,
acting alone or in combination with other existing or future uses,
activities and development, will cause unacceptable increases in flood
heights, velocities and frequencies.
(2) Restricting or prohibiting certain uses, activities
and development from locating within areas subject to flooding.
(3) Requiring all those uses, activities and developments
that do occur in flood-prone areas to be protected and/or floodproofed
against flooding and flood damage.
(4) Protecting individuals from buying lands and structures
which are unsuited for intended purposes because of flood hazards.
