No person shall dig up, cut down, destroy or injure in any way any shade, ornamental or useful tree, standing or growing within the limits of any street or public way in said Town, without the consent in writing of the Tree Warden first having been obtained therefor, and the Tree Warden shall grant no such approval without consent of the owner of the tree in that portion of the street or way upon which the tree stands, unless the public safety requires the removal of such tree.
