A special town fund is hereby created and shall be designated as the "Town of New Milford Sewerage System Development Fund," which fund shall be kept separate and apart from all other funds of the Town. There shall be paid into such fund the proceeds of all special benefit assessments made by the Sewer Commission to meet, in whole or in part, the cost of the Town sewerage system and the proceeds of all notes and bonds issued by the Town for such purpose. The moneys in the fund shall be used solely for the payment of the development costs of such sewerage system, including but not limited to the interest or discount of notes of the Town evidencing temporary borrowings to meet such costs and the expense of preparing, issuing and marketing the same. Any balance of moneys in such fund, after payment in full of the development costs, shall be paid into the bond service reserve account, which is hereby created.

(a) 
A special town fund is hereby created and shall be designated as the "Town of New Milford Sewerage System Administration Fund," which fund shall be kept separate and apart from all other funds of the Town. There shall be paid into such fund all charges made by the Sewer Commission for connections with or use of the Town sewerage system and all other funds available to pay the costs of maintaining and operating the same, from whatever source derived, including proceeds of insurance. The moneys in the fund shall be used solely for the following purposes and in the following order:
(1) 
To pay costs directly chargeable to the maintenance and operation of the sewerage system.
(2) 
To pay installments of principal and interest on any bonds issued by the Town to meet the development costs of the sewerage system.
(3) 
To establish such repairs, maintenance and replacement reserve as shall be deemed advisable by the Sewer Commission.
(b) 
Any balance of moneys in the fund not required for the aforesaid purposes shall be annually transferred to the bond service reserve account.

Night soil (septic tank pumpings) shall only be disposed of by the following methods:
(a) 
Processing at the Town sewer plant.
(b) 
Any method of burial conforming to the requirements of the Connecticut Public Health Code.

Installations of sewage disposal systems or any component thereof shall conform to the requirements of this Sanitary Code, as defined in § 22-1(c), and any amendments thereto.

Before any newly installed or rebuilt private or public sewage disposal system is covered, the Director of Health or the Director's authorized designee shall inspect the same and either issue in writing any violations of this Sanitary Code, or if none, he shall issue a permit to discharge.

No person shall transport night soil unless such person has been issued a permit to do so.

A permit for the installation of a private or public sewage disposal system shall be obtained before any such installation is undertaken. The permit shall be obtained prior to the filing of a certificate of intention to build and prior to the commencement of any footing or construction.

The Director of Health shall prepare application forms and shall prepare and issue permits required by §§ 22-21 and 22-22 or by the Connecticut Public Health Code to qualified applicants.
(a) 
For the initial installation of private sewage disposal systems for new construction of buildings, the Director of Health shall charge the following fees:
(1) 
Single-family, multiple-family and commercial and/or industrial buildings:
a. 
Sewage disposal system permit: $250.
b. 
Soil testing fee for deep hole and percolation tests: $100.
c. 
Engineered plan review fee, per lot: $200.
(b) 
For the repair or replacement of private sewage disposal systems for existing construction, the Director of Health shall charge the following fees:
(1) 
Single-family, multiple-family and commercial and/or industrial buildings:
a. 
Sewage disposal system permit: $125.
b. 
Septic tank only: $75.
c. 
Soil testing fee: none.
d. 
Engineered plan review fee: none.
(c) 
For the review of sewage disposal and water supply system plans for feasibility for subdivisions referred to the Director of Health through the New Milford Planning Commission:
(1) 
Proposed subdivisions of lots for the purpose of single-family, multiple-family and commercial and/or industrial buildings:
a. 
Each lot: $100.
(d) 
For inspection and approval of food service establishments, see Chapter 6C.
(e) 
For the review and approval of the private sewage disposal system for additions and/or renovations to buildings, the Director of Health shall charge the following fees:
(1) 
Single-family, multiple-family and commercial and/or industrial buildings:
a. 
Approval requiring a site inspection: $75.
(f) 
For the review and approval of each water supply well permit, the Director of Health shall charge the following fees:
(1) 
New well (each): $100.
(2) 
Redrill, deepen or hydrofracture of existing well or well abandonment (each): $25.
(g) 
For the annual relicensing of day-care centers, the Director of Health shall charge the following fees:
(1) 
Day-care centers licensed for 12 or more children: $100.

A night soil sewer use fee shall be established for the disposal services of the Town sewer plant. Such fee shall be presented at the public hearings on sewer use rates and set in the same manner as the sewer use rates.
