No person shall install, in any street, any new curb or walk
or combined curb and gutter, or relay any existing curb or walk or
combined curb and gutter, unless he shall first apply for and obtain
a permit therefor from the Board of Selectmen, but the provisions
of this section shall not prevent the making, without such permit,
of minor repairs to an existing curb or walk or combined curb and
gutter by the owner of the property in front of which such curb or
walk or combined curb and gutter is located, or by such owner's
agent.

Every person making application for the permit required by this
division shall file with the Board of Selectmen a satisfactory bond
in the sum of $1,000, conditioned substantially that the applicant
shall indemnify and save harmless the town and the Board of Selectmen
and its agents from all suits and actions of every name and description
brought against the town, or any officer of the town, for or on account
of any injuries or damage received or sustained by any person in consequence
of or as a result of any work performed by such applicant, his servants
or agents, or of any negligence in guarding such work or of any act
or omission of such applicant, his servants or agents, that such applicant
shall faithfully perform such work in all respects, and shall replace
and restore that portion of any street, in which such applicant, his
servants or agents shall make any excavation, to as good condition
as that in which the same was before such work was performed.

A Town Highway Department Foreman shall supervise the construction
of all new curbs, walks, combined curbs and gutters, and all other
work of a similar nature installed under the provisions of this article,
but such supervision shall not relieve the permittee from any obligation
to perform the work strictly in accordance with the rules and regulations
and specifications therefor, or from the responsibility which he is
expected to assume.
