The Township hereby adopts the current Federal Highway Administration
Manual on Uniform Traffic Control Devices, hereafter known as "MUTCD,"
except as hereby supplemented and amended, as it controls and regulates
whenever construction maintenance operations or utility work obstructs
the normal flow of traffic. Any person, contractor or utility who
fails to comply with the provisions of the MUTCD, while performing
such work, is in violation of this article.

It shall be the responsibility of the person, contractor or,
in the case of a public utility, as required under the public utility
agreement wishing to conduct work on, under or above the roadway to
contact the Teaneck Police Department's Traffic Bureau to arrange
a preconstruction meeting. Plans must be submitted to the Traffic
Bureau which detail the proposed plan for the safe movement of traffic
during such period of construction work. In the event of an emergency,
such as a gas leak, water main break, or fire in electric or communication
lines, the Police Department shall be immediately notified by the
person, contractor or utility so as to provide police officers to
ensure that all safety matters are adhered to. Except in emergency
situations, all permits from the Township Engineer, County Engineer
or other appropriate officials shall be obtained by the person, contractor
or utility prior to any road opening or sidewalk removal. In the case
of emergency situations, all permits shall be obtained as soon thereafter
as practical and made available for inspection by or to the appropriate
Township authorities.

The person, contractor or utility shall provide the Teaneck
Township Police Department's Traffic Bureau with at least two emergency
contact telephone numbers prior to the start of any work which shall
be used in case of emergency problems at the construction or maintenance
site. If for any reason emergency contacts cannot be reached, or if
the emergency contact person does not respond to a call from the Police
Department within a reasonable amount of time, dependent upon the
emergency, to correct a hazardous condition, the Township Manager
may authorize Township employees or contractors engaged by the Township
to correct such hazardous conditions. Reasonable fees shall be charged
to the person, contractor or utility for such emergency services provided
by the Township or at the request of the Township.

No construction, maintenance operations or utility work on any
street, roadway or highway in the Township shall start before 8:00
a.m. or after 5:00 p.m. This time limit may be adjusted by the Teaneck
Police Department or Engineering Department to permit work at other
times if it is determined that such construction, maintenance operations
or utility work between 8:00 a.m. and 5:00 p.m. shall substantially
delay traffic or cause a safety or heath hazard.

Road closings or traffic detours shall only be permitted when
approved by the Teaneck Police Chief or Township Engineer, as provided
by law.

Traffic directors shall be posted at construction, maintenance
or utility sites when determined by the Teaneck Police Chief to be
necessary to provide for the safe and expeditious movement of traffic.
When so determined, said traffic directors shall be provided for at
the expense of the person, contractor or utility for providing such
work.

The Teaneck Police Chief shall have the authority to stop work,
including the removal of equipment, vehicles and materials stored
within the street, road or public right-of-way, the backfilling of
open excavations or other related work, in order to abate an nuisance
or safety hazard or for any other violation of this article. Such
stop-work order shall be issued in concurrence with the Township Engineer.

Any person, contractor or utility violating any provision of
this article shall, upon conviction thereof, for the first offense
pay a fine of not less than $100 nor more than $500; for a second
offense, upon conviction thereof, pay a fine of not less than $250
nor more than $500; for a third or subsequent offense, upon conviction
thereof, pay a fine of not less than $500 and/or be imprisoned in
the county jail for a term not exceeding 90 days. A separate offense
shall be deemed committed on each day during or on which a violation
occurs or continues to occur.
