The Town Clerk is hereby designated as the records access officer,
who shall have the duty of coordinating agency response to public
requests for access to records. The records access officer shall be
responsible for ensuring compliance with the regulations of Article
6 of the Public Officers Law and with the regulations of the Committee
on Open Government, Part 1401, Chapter 25, of the New York Codes,
Rules and Regulations, and with the authority of this chapter.
The Town Hall, 531 Old Front Street, Binghamton, New York, is
hereby designated as the location where records of the Town Board
shall be available for public inspection and copying.
The hours from 9:00 a.m. to 4:00 p.m. are hereby designated
as the hours during which the Town Board shall accept requests for
public access to records and produce records relating to Town Board
matters.
All requests for public access to records shall be made in writing
to the records access officer, which requests shall reasonably describe
the record or records sought, and, whenever possible, the person requesting
such record or records shall supply information regarding dates, file
designations and other information helpful in describing the records
sought.
The Town Board is hereby designated to hear appeals regarding
the denial of access to records pursuant to the Freedom of Information
Law.
The fee recited in Section 1401.8, Chapter 25, of the New York
Codes, Rules and Regulations, attached hereto, is hereby adopted by
the Town Board.
Pursuant to Section 1401.9 of the rules of the Committee on
Open Government, the notice attached hereto as Exhibit B shall be
posted on the Town bulletin board.
The general rules and regulations promulgated by the Committee
on Open Government are hereby adopted by the Town Board of Dickinson,
and all other departments, boards, bureaus, divisions, commissions,
committees and other governmental entities performing a governmental
or proprietary function for the Town of Dickinson shall promulgate
their own rules and regulations in conformance with the Freedom of
Information Law and the rules of the Committee on Open Government
as quickly as possible and will file said rules and regulations with
the Town Clerk of the Town of Dickinson. In any event, such rules
and regulations shall be promulgated and filed with the Town Clerk
of Town of Dickinson no later than November 1979.
