The Town Board of the Town of Dickinson may hereafter apportion and assess upon and collect from the Town of Dickinson the expense of the reconstruction of damaged or deteriorated curbs, gutters and sidewalks within the public streets located within the Town of Dickinson. In no case, however, shall the total amount assessed against the Town of Dickinson exceed 50% of the total construction cost. Any such assessment shall be subject to the availability of funds as provided for in the Town of Dickinson budget and must be approved by the majority of the members of the Town Board of the Town of Dickinson.
