A.
For the purposes of this Bylaw the Town is divided into the following types of districts:
AR
(Agricultural-Residential)
B
C
(Commercial)
MR
(Multiple Residence)
W
(Watershed Protection and Floodplain)
WFH
(Watershed Protection and Flood Hazard)
B.
All areas not governed by other district provisions are in an AR District, except that a WFH District is an overlay district imposing within its boundaries provisions in addition to those of the basic underlying district. Districts other than AR Districts are defined in the Zoning Map,[1] including § 125-43, Zoning Map supplement, with the following interpretations:
(1)
Where district boundaries are indicated by a specified distance from a way, distance is measured from the center line of the way.
(2)
An area on the Zoning Map designated as W and/or coded Wxyz (W plus three digits) indicates the general location both of the W District and of its associated WFH District. However, the W and WFH District boundaries are defined by the corresponding elevations, gradients, or other dimensions given in § 125-43, Zoning Map supplement, or on the Zoning Map.
(3)
Where a reach of a stream or other watercourse is designated as a W (and WFH) District and the extent of such reach is not otherwise indicated, such reach terminates at any way, dam, stone wall, pond, or confluence with another watercourse, shown on the Zoning Map.
(4)
A W (or WFH) District shown on the Zoning Map only as a watercourse extends the specified half width on either side of a line generally paralleling the center line of the watercourse, but offset from said center line so that the cross section of the district at each point provides equal maximum elevation on either side of the watercourse center line; provided, however, that the offset shall be limited sufficiently that:
(a)
The watercourse center line is inside the district by at least 10 feet; and
(b)
A WFH District contains its underlying W District.
(5)
Any pond, stream, or other watercourse other than a swamp, shown on the Zoning Map but not otherwise designated is in a W District and in a WFH District. The half width of such undesignated districts shall be 10 feet as a W District and 20 feet as a WFH District.
(a)
W District elevation for an undesignated pond shall be that of:
[1]
The emergency spillway; or
[2]
If there is no such spillway, the exit flow line.
(b)
WFH District elevation shall be one foot above Subsection B(5)(a)[1] or two feet above Subsection B(5)(a)[2].
(6)
Other W or WFH Districts are bounded by a contour having:
(a)
The indicated elevation; or
(b)
At a reference point the indicated elevation, with elevation of the contour rising (falling) at the indicated plus (minus) gradient in feet per feet of distance from the reference point. The reference point is located at the stream center line at the applicable culvert, bridge, dam, or stone wall, or at other point as specified.
(7)
Any driveway shown on the Zoning Map within a W or WFH District is not considered a part of said district.
(8)
Watershed Greenspace Buffer District. A buffer overlay district created to protect the values inherent in a watercourse, its wetlands, and its floodplains. The area within the buffer district shall be a green area (see definition).
(9)
Nashua River Watershed Greenspace Buffer District. A buffer district extending along the Nashua River, from its highest point in Harvard northward to its lowest point in Harvard, shall include an area 300 feet from the center line of the Nashua River.

Editor's Note: The Zoning Map is included at the end of this chapter.
