As used in this article, the following terms shall have the
meanings indicated:
EMPLOYMENT
The rendering of services for compensation or other remuneration
as either an employee, independent contractor, consultant, partner
or stockholder or sole proprietor, but shall not include volunteer
services for a charitable, religious, or their nonprofit corporation
or association.
REGULARLY SCHEDULED WORKING HOURS
The hours of a day which an employee of the City of Englewood
is usually and customarily required to be on duty, whether on steady
shifts or rotating shifts.
The provisions of this article shall apply to all employees
of the City of Englewood except as may otherwise be provided by collective
bargaining agreements or employment contracts.
No employee of the City of Englewood shall engage in outside
employment without first providing prior written notice thereof to
such employee's department head. In the event of outside employment
by a department head, the department head shall first notify the City
Manager. In the case of outside employment by the City Manager, the
City Manager shall first notify the City Council.
No employee of the City of Englewood shall engage in outside
employment under the following circumstances:
A. During regularly scheduled work hours except while on vacation or
during approved time off.
B. Which results in a conflict of interest with the proper performance
of the employee's employment with the City of Englewood.
C. Which adversely affects the ability of the employee to perform his
normal job duties as an employee of the City of Englewood.
D. Which is in violation of any collective bargaining agreement, employment
contract, state or federal statute, or municipal ordinance.
E. During any time period for which the employee is excused from duty
due to sickness or injury.

No employee of the City of Englewood shall transact any outside
employment through the use of any City equipment or facilities, including
the use of City typewriters, computers, telephones, stationery, the
services of any other City employee, City motor vehicle, DPW equipment,
or buildings and offices of the City of Englewood, nor shall any employee
of the City of Englewood utilize the City's telephone number or mailing
address for the transaction of outside employment.
