Pursuant to § 308, Article 3 of the Public Health Law and § 130, Subsection 15, of Article 9 of the Town Law, the Town Board sitting as the Town Board of the Town of Coxsackie does hereby enact the following article for the purpose of protecting the health, safety and general welfare of such Town.
When used in this article, the following words and phrases shall have the meanings indicated:
INDUSTRIAL WASTE PRODUCTS
Any liquid, solid or simplified solid waste generated by industrial or commercial operations. Such wastes include but are not limited to residue sludges, greases, oils, solvents, spent chemicals, acids, slag, cinders and similar wastes, but do not include wood, paper and packaging materials.
PCB
Any waste or substance containing polychlorinated biphenyl.
PERSON
Any individual, public or private corporation, political subdivision, municipality, industry, partnership, association, firm, trust or estate.
RADIOACTIVE WASTES
Any waste or substance, including water, containing or emitting radiation.
SEWAGE WASTES
Any liquid, solid or semisolid waste from septic tanks, cesspools, domestic sewer systems and sewage treatment facilities, whether such wastes be treated or untreated.
TOWN
The Town of Coxsackie, Greene County, New York.
No person shall throw, dump, deposit, bury or cause to be thrown, dumped, deposited or buried on any land in the Town of Coxsackie any radioactive wastes or PCBs from any source whatsoever. No persons shall permit such throwing, dumping, depositing or burying thereof upon property owned, leased or controlled by such person.
No person shall throw, dump, deposit or bury or cause to be thrown, dumped, deposited or buried on any lands in the Town of Coxsackie any industrial waste products or sewage wastes from any source whatever originating outside the Town of Coxsackie, and no persons shall permit such throwing, dumping, depositing or burying thereof upon property owned, leased or controlled by such persons.
Any industrial waste products or sewage wastes originating within the Town of Coxsackie may be dumped, deposited, buried or disposed of in a sanitary landfill approved and operated in accordance with Part 360, Chapter 4, Title 6 of the Environmental Conservation Rules and Regulations of the State of New York (6 NYCRR 360).

Any violation of § 125-3 or 125-4 of this article shall be deemed a misdemeanor, and any person violating either section shall, upon conviction thereof, be punishable by a fine not exceeding $1,000 or imprisonment for not more than four months, or both.
The Town may seek an injunction to restrain any activities in violation of § 125-3 or 125-4 in a court of competent jurisdiction.
