[HISTORY: Adopted by the Board of Trustees of the Village of Nissequogue 3-26-1973 by resolution. Amendments noted where applicable.]
The members of the Board of Trustees, acting as the Village Board of Fire Commissioners pursuant to the provisions of § 89 Subdivision 19 of the Village Law,[1] hereby establish the Nissequogue Fire Department and, in accordance with the powers granted to them by Article 8 of said Village Law, direct that the following actions be taken forthwith:
A. 
An overall capital budget for the acquisition of land, the construction of a suitable firehouse, the purchase of needed apparatus and equipment and all other necessary or incidental expenses in connection therewith shall be prepared.
B. 
The Village Attorney and the Village Treasurer shall proceed with the required steps, including the retention of special legal counsel, to fund whatever portions of the capital budget as may be deemed necessary for carrying out the purposes of this chapter, by means of issuing serial bonds or bond anticipation notes, in accordance with the applicable provisions of the Constitution of the State of New York and the Local Finance Law, the incurrence of which indebtedness shall be subject to a permissive referendum to be voted upon at a special Village election as soon as practicable.
C. 
A suitable and centrally located plot shall be acquired by purchase or condemnation and the necessary building erected thereon to house the apparatus and equipment of the Fire Department, such construction to be contracted for in accordance with the applicable provisions of the General Municipal Law.
D. 
Such fire engines, hose, tools, implements, apparatus and other equipment suitable and necessary to prevent and extinguish fires in this Village, or for the purposes of an emergency rescue and first aid squad, together with such uniforms for active members of the Fire Department as may be deemed necessary, shall be purchased in accordance with the applicable provisions of the General Municipal Law.
E. 
Rules and regulations for the admission, suspension, removal and discipline of members, officers and employees of the Fire Department shall be formulated and their powers, duties and compensation, if any, prescribed and fixed. Appointments of volunteer members, including officers of the Fire Department, shall be made, and, if deemed necessary, other persons may be appointed to take care of the property of the Fire Department, or act as call men and their compensation fixed.
