The Village Board of the Village of Nissequogue declares its
intent to control unusually large gatherings of persons which, if
not regulated, would be detrimental to the life, health, welfare and
good order of the people of the Village of Nissequogue and to give
the municipality the ability to provide for sanitary facilities, refuse
disposal, medical care and other essential services. By this enactment,
the Village Board intends to promote the health, safety, moral and
general welfare of the people of the Village of Nissequogue and the
exercise of its police powers.
As used in this chapter, the following terms shall have the
meanings indicated:
LARGE ASSEMBLY
Any assemblage or gathering of more than 200 persons on any
parcel of property within the Village.
No parade or large assembly, as defined above, on public or
private property within the Village shall be permitted unless a permit
shall have been obtained from the Village Board of the Village of
Nissequogue at least four weeks before the time of holding of said
parade or large assembly. Application for said permit shall clearly
set forth the following:
A. The purpose of the parade or assembly.
B. The managers or parties in control of the same.
D. The sanitary facilities available.
E. The proposed parking facilities.
F. Arrangements for disposal of refuse.
G. Availability of medical services.
H. Accessibility of fire or emergency equipment, if applicable.
I. Compliance with Chapter
83, Noise, if applicable.
J. Specify whether any speeches are to be made and if so, by whom.
K. Specify whether any firearms are to be carried or displayed and if
so, the type of the same.
L. Whether or not any moneys are to be charged or solicited for entrance
to said parade or assembly.
M. Evidence of compliance with all applicable public authorities and
regulations.
The Village Board in the issuance of a permit shall have the
right to specify conditions for the issuance of said permit, which
conditions may apply with regard to any or all of the above provisions
of the application. In addition, the Village shall be authorized to
request a bond to be posted to insure compliance with any conditions
that may be specified.
This chapter and the necessity of obtaining a permit hereunder
shall not apply to not-for-profit corporations, operating clubs with
established meeting halls, educational institutions or on Town of
Smithtown beaches with requisite permits from the Town of Smithtown.

Any person committing an offense against any provision of this
chapter shall, upon conviction thereof, be guilty of a violation pursuant
to the Penal Law of the State of New York, punishable by a fine not
exceeding $250 or by imprisonment for a term not exceeding 15 days,
or by both such fine and imprisonment. The continuation of an offense
against the provisions of this chapter shall constitute, for each
day the offense is continued, a separate and distinct offense hereunder.
The Board of Trustees may enforce compliance with the provisions
of this chapter by applying to the appropriate court for injunctive
relief.
