No person shall leave, or cause to be left, any garbage can,
box, bag or other refuse container (hereinafter collectively referred
to as "container") within the paved line of any of the highways of
the Village.
No person shall place or permit to be placed any such container
along the side of any of the highways of the Village unless the same
is securely covered and protected so that it cannot be broken open
by wandering domestic or wild animals.
No such container shall be placed along the side of any of the
highways of the Village except along a lot or premises from which
collection of refuse is to be made, and then only on those days when
such collection is scheduled, and any such container not collected
shall be removed therefrom within 12 hours after collection has been
made.
The owners or occupants of any lot or premises abutting any
of the highways of the Village upon which any such container shall
be broken into or overturned and the contents thereof scattered on
or along the side of such highway shall be responsible for the removal
of the same which shall be promptly done, or, in default thereof,
the Village officials who are authorized to issue appearance tickets
shall cause the same to be removed and charge the expense thereof
to such owners or occupants.
Any person committing an offense against any provision of this
article shall, upon conviction thereof, be guilty of a violation pursuant
to the Penal Law of the State of New York, punishable by a fine not
exceeding $250 or by imprisonment for a term not exceeding 15 days,
or by both such fine and imprisonment. The continuation of an offense
against the provisions of this article shall constitute, for each
day the offense is continued, a separate and distinct offense hereunder.
