No person shall construct or maintain any driveway or other right-of-way so that drainage therefrom shall damage or cause to be deposited on any of the highways of the Village ashes, dirt, rubbish, snow, ice or other obstructions which could endanger safe passage over said highways. The owners or occupants of any lot or premises abutting any such highway and from which such deposits originate shall be responsible for the removal of the same and, upon demand of the Village officials who are authorized to issue appearance tickets, shall forthwith remove any accumulations of such deposits, or, in default thereof, said Village officials may cause the same to be removed and charge the expense thereof to such owners or occupants. In the event that any such drainage or the deposits therefrom shall continue, from time to time, and remain unabated so as to constitute a nuisance on or cause damage to any of the highways of the Village or, in the opinion of said Village officials, create a hazardous or dangerous condition upon said highways, such Village officials shall thereupon report the circumstances to the Board of Trustees. After consideration of all the facts and if said Board shall determine that such drainage or the deposits therefrom do cause damage to said highways or constitute a nuisance or a hazardous or dangerous condition thereon, the owner of the premises at fault shall be instructed by the Mayor to install the necessary drainage improvements, and the same shall be done forthwith in accordance with the procedures contained in Chapter 51, Building Code Administration and Enforcement, pertaining to new driveway installations.
Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
