This chapter shall be known as the "Regulation of Septic Systems
Law."
The failure rate of septic systems in areas where the seasonal
high groundwater table is three feet or less is very high. Such failures
often result in groundwater contamination and can affect both existing
and future supplies of drinking water. Protection of the public health
and safety require the regulation by the Village of Nissequogue of
the use and placement of septic systems in such areas.
A.
No septic system shall be permitted in areas where the depth to the
seasonal high groundwater table is three feet or less or within 150
feet of the upland boundary of a freshwater or tidal wetland, as shown
on the Freshwater Wetlands Map and the Tidal Wetlands Map, as from
time to time amended and filed by the New York State Department of
Environmental Conservation.
B.
No septic system shall be permitted within 150 feet of the crest
of a bluff or placed where impermeable layers of soil or clay would
cause septic effluent to leach onto or undermine the face of the bluff.
