In order to ensure that the Village of Ravena does not invest
time and money in providing basic training for a police officer without
receiving the benefit of that training over a limited period of time
after its completion, the Board of Trustees hereby determines that
to retain the services of adequately trained police officers, to reduce
the potential loss of the investment made in the training of police
officers and to limit the disruption of staffing requirements which
might occur if a recently trained police officer were to accept employment
with another law enforcement agency, the Board of Trustees hereby
enacts this article, pursuant to provisions of the Municipal Home
Rule Law and Village Law § 4-412, to establish a means by
which the municipal investment in the training of a police officer
may be recovered in the event an officer were to accept another employment
after having been trained.
As used in this article, the following terms shall have the
meanings indicated:
EXPENSES ASSOCIATED WITH TRAINING
Any direct or indirect expenditure made by the Village of
Ravena in conjunction with providing a police officer with basic training.
This term includes but is not limited to any reimbursement for the
cost of travel, lodging, meals or books and any payment made by the
Village of Ravena to a third party for a benefit available to the
individual during the time of training.
PROVOKED DISCHARGE
A discharge occasioned by a deliberate or willful act of
a police officer at least partially motivated by an intention to avoid
the reimbursement obligation set forth under the terms of this article.
VOLUNTARY SEPARATION
Any resignation from the Village of Ravena Police Department
occasioned by an act of an individual police officer, and shall also
include a provoked discharge.
Should it be necessary to enforce its claim for reimbursement,
the Village of Ravena may initiate a civil action in a court of competent
jurisdiction.
A copy of this article shall be provided to any applicant interviewed
for employment with the Village of Ravena Police Department for the
position of police officer, but the failure of the Village of Ravena
to do so shall not affect the validity of this article as it relates
to an individual, provided that he or she was advised of the terms
of this article prior to separation.

The Police Department of the Village of Ravena is hereby abolished.
