The making and creating of disturbing, offensive or excessive noise within the jurisdictional limits of the Village of Ravena is a condition that is a detriment to the public health, comfort, convenience, safety and welfare of the citizens. This section is to be construed liberally but is not intended to discourage the enjoyment by resident and visitors of normal, reasonable and usual activities.
A. 
No person, shall make or create or allow any unreasonable noise that causes public inconvenience, annoyance or alarm, or recklessly creates a risk thereof. Unreasonable noise is any disturbing, excessive or offensive sound of such level and duration as to be or tend to be injurious to the health or welfare of individuals or which would unreasonably interfere with the enjoyment of life or property or that disturbs a reasonable person of normal sensitivities.
B. 
The following acts are declared to be prima facie evidence of a violation of this section. This enumeration shall not be deemed exclusive.
(1) 
An unnecessary noise from any source between the hours of 10:00 p.m. and 7:00 a.m. the following day.
(2) 
Noise from a dog, livestock, domestic or other animal (except wild animals) that is continuous and exceeds 15 minutes.
(3) 
Noise from an alarm system on any building or vehicle or vessel which exceeds 15 minutes.
(4) 
Noise from any sound-generating, sound-amplifying or sound reproduction system; operating or playing any radio, television, portable music player or any similar electronic or digital device that plays, reproduces or amplifies sound in such a manner as to be heard 60 feet from its source or over any property line.
(5) 
The erection, including excavation, demolition, alteration or repair, of any building or property between the hours of 10:00 p.m. and 7:00 a.m. the following day, and on weekends between 10:00 p.m. and 8:00 a.m. the following day, except in the case of public safety or emergency.
(6) 
The sounding of any horn or signaling device from any vehicle or vessel for any unnecessary or unreasonable period of time.
(7) 
The making of improper noise or disturbances while operating a motor vehicle.
(8) 
Offering for sale anything by shouting or outcrying or by the use of any drum, loudspeaker or other instrument or device upon the public street or sidewalks.
(9) 
Yelling, shouting or hooting at any time or place so as to annoy or disturb the quiet, comfort and repose of a reasonable person of normal sensitivities.
The provisions of this section shall not apply to the following acts:
A. 
The emission of sound for the purpose of alerting persons to the existence of an emergency or noise generated as a result of the emergency operations of a municipality, the Police Department, Fire Department or rescue squad.
B. 
Noise from municipally sponsored celebrations or events.
C. 
Noise generated by the installation and maintenance of utilities.
D. 
The operation or use of any organ, radio, bell, chime or other instrument, apparatus or device by any church, synagogue or school licensed or chartered by the State of New York, provided such operation or use does not occur between the hours of 10:00 p.m. and 7:00 a.m.
E. 
Noise from domestic power tools, lawn mowers, snowblowers and other agricultural equipment, when such is equipped, when applicable, with properly functioning mufflers, except as provided in § 83-16.
F. 
Noise from a gas-powered portable electric generator providing emergency power to a home or business, and only during the duration of the power outage or emergency.
A. 
A violation of any of the provisions contained in this section shall constitute an offense, punishable by a fine of not to exceed $250, or by imprisonment for not more than three days for each violation, except that:
(1) 
When the person was found to have previously violated any of the provisions of this chapter within the preceding five years, the fine may be of not less than $250 nor more than $500 or by imprisonment for not more than seven days for each violation; and
(2) 
When the person was found to have previously committed two or more such violations within the preceding five years, the fine may be of not less than $500 nor more than $1,000 or by imprisonment for not more than 15 days for each violation. These penalties shall be in addition to any other penalty provided by law.
B. 
The Village of Ravena may also seek injunctive relief to prevent the continued violation of this section.
The noise control requirement established by this article shall be administered and enforced by any law enforcement agency that has jurisdiction in the Village of Ravena and any other employee as authorized by the Village of Ravena Board of Trustees.
If any word, phrase, or part of this article shall be declared unconstitutional, the same shall be severed from the remainder of this article and said remainder shall continue in full force and effect.
This article shall become effective immediately upon filing with the Secretary of State.
