As used in this article, the following terms shall have the meanings indicated:
PUBLIC PLACE
Any place to which the general public has access and a right to resort for business, entertainment or other lawful purpose, but does not necessarily mean a place devoted solely to the use of the public. It shall also include the front or immediate area of any store, shop, restaurant, tavern or other place of business or residence and also includes public grounds, areas, rights-of-way or parks.
SOLICITATION OF EMPLOYMENT
The offer to be hired or the offer of employment as well as the agreement to become employed or to perform work or services for hire.
It shall be unlawful for any person, either alone or in consort with others in a public place to:
A. 
Obstruct any public street, public highway, public sidewalk or any other public place or building by hindering or impeding or tending to hinder or impede the free and uninterrupted passage of vehicles, traffic or pedestrians for the purpose of soliciting the employment or hiring workers.
B. 
Solicit employment on a per diem, hourly or any other basis from contractors, landscapers or any employer or prospective employer.
C. 
Hire or agree to pay any laborer or employee on or in any public place other than a place owned by either the employer, laborer or employee or at a place licensed for such activity, including, without being limited to, an employment agency.
When any person causes or commits any of the actions described in the preceding section, a police officer, in the exercise of reasonable judgment, may order that person to stop causing or committing such action and to move on or disperse. Such police officer may, alternatively, issue a summons or complaint for a violation of this section with said summons or complaint being issued to either the person soliciting such employment or the person providing such employment. Any person who fails or refuses to obey the order of such police officer shall be guilty of violation of this section with penalties to be determined pursuant to the general penalty provisions of the City Code.
