From and after the passage and approval of this chapter, no
person or persons, firm or corporation shall, within the corporate
limits of the Borough of Masontown, sell or offer for sale at any
time or have in his or her, their or its possession or custody for
sale, at wholesale or retail, any fireworks, firecrackers, torpedoes,
bombs, squibs, rockets, pinwheels, fire balloons, Roman candles, detonating
or torpedo canes, paper caps or paper cap pistols or any other kind
of fireworks.
The use or discharge of any fireworks, firecrackers, torpedoes, bombs, squibs, rockets, pinwheels, fire balloons, Roman candles, detonating or torpedo canes, paper caps or paper cap pistols or any other kind of fireworks within the corporate limits of the Borough of Masontown is hereby prohibited except as provided in §
74-3 of this chapter.
Nothing contained in this chapter shall prevent the Council
of the Borough of Masontown, by proper resolution, from permitting
the use and discharge of fireworks on public occasions and under such
conditions and supervision as Council may see fit to impose.
Any persons or persons, firm or corporation violating any of
the provisions of this chapter shall, upon conviction thereof before
the District Justice of said borough, be punishable by a fine of not
more than $300 and costs of such proceedings or, upon default of payment
of such fine and costs, by imprisonment in the county jail for a term
of not more than 30 days; provided, however, that if the District
Justice determines that the defendant is without the financial means
to pay the fines and costs immediately or in a single remittance,
such defendant shall be permitted to pay the fines or costs in installments
and over such periods of time as the District Justice deems to be
just.
