A. 
Permit required.
(1) 
No person shall kindle or maintain any bonfire or rubbish fire or authorize any such fire to be kindled or maintained on or in any public street, alley, road or public grounds without a permit or other proper authorization during construction or demolition of building or structures.
(2) 
No waste materials or rubbish shall be disposed of by burning on the premises or in the immediate vicinity without a permit or proper authorization having been obtained.
B. 
Location restricted. No person who shall have obtained a permit may start any fire or authorize any other person to kindle or maintain a fire unless the location is not less than 50 feet from any structure and adequate provisions are made to prevent such fire from spreading to within 50 feet of any structure or wooded area.
Nothing herein contained shall prevent any person from starting a fire in an approved waste burner with closed top located safely and at least 15 feet from any structure.
The Chief of any fire department may within his fire district prohibit any and all bonfires, outdoor rubbish fires, burning of leaves, etc., when atmospheric conditions or other circumstances make such fires hazardous.
The permit herein required shall be obtained from the Town Clerk of the Town of Johnstown, who shall secure the approval of the Chief or Assistant Chief of the fire district where the burning is to take place.
Any person who violates this chapter shall be guilty of a violation punishable by a fine not to exceed $25 or imprisonment for a period not to exceed 10 days, or both.
