Property owners whose properties are located in the Cross Keys
Water Service District, as hereinafter defined, shall be required
to connect to the public water system to be constructed in the Cross
Keys Water Service Area by the Doylestown Township Municipal Authority
within 90 days of written notice to do so. The obligation of the owners
of residential property to connect to the public water system shall
be conditioned upon the costs of the infrastructure and the cost to
bring public water to the house being borne by the Department of Environmental
Protection or others.
The Cross Keys Water Service District shall include that portion
of Doylestown Township described as being contained within the area
bordered by Old Dublin Pike, Campbell Drive, Park Drive, Catherine
Way, Dorothy Avenue and Swamp Road (Route 313), which said Cross Keys
Water Service District is also defined on the map attached hereto
and incorporated herein as Appendix A.
Any property owner required to connect to the public water system
who fails to do so within 90 days after written notice to do so has
been served upon the property owner either by Doylestown Township
or the Doylestown Township Municipal Authority, said Township and/or
Authority may thereupon enter upon the property of the property owner,
construct the necessary facilities to connect to public water, and,
upon completion of that project, assess the full cost and expense
of said construction to the property owner. The Township and/or the
Authority is further authorized to lien the real property of the property
owner in the event that the Township and/or Authority shall complete
the construction of the connection to public water.
Any property owner who shall fail to comply with the requirement
to connect to public water as set forth herein shall be subject to
the imposition of a penalty and/or fine in an amount not to exceed
$1,000, which said penalty and/or fine shall be set by the District
Judge. Each day that the order to connect is violated or that the
property owner fails to comply with same shall constitute a separate
and distinct violation.
To the extent the provisions of this article are inconsistent
with the provisions of any prior ordinance adopted by Doylestown Township
as set forth in the Code of Ordinances of Doylestown Township, said
prior ordinances and the Code of Ordinances of Doylestown Township
are hereby repealed to the extent of the inconsistency. The provisions
of this article, however, shall not modify and/or amend any prior
ordinances of the Township of Doylestown related to the mandatory
connection to public water except as said ordinances may relate to
the Cross Keys Water Service District as identified herein.
