Editor's Note: This ordinance repealed former Art. II, Defined Contribution Retirement Program, adopted 12-17-2009 by Ord. No. 2009-24, as amended.
Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:
A. 
City Administrator, unless filled by promotion of a present active Public Employees Retirement System (PERS) member.
B. 
City Attorney when an employee and not engaged pursuant to a professional service contract.
C. 
Municipal Prosecutor if there is one.
D. 
Municipal Court Judge if there is one.
E. 
Municipal Engineer except that if the individual appointed has been a member of PERS prior to 2007 and has continuously been a member since that time.
F. 
Members of the Board of Commissioners.
Individuals holding a professional license or certificate to perform and who are serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2 and therefore are eligible to join or remain in PERS:
A. 
Tax Collector.
B. 
Chief Financial Officer.
C. 
Construction Code Official.
D. 
Qualified Purchasing Agent.
E. 
Tax Assessor.
F. 
Registered Municipal Clerk.
G. 
Certified Public Works Manager.
This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.), as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
A copy of this article shall be filed with the Director of the Division of Pensions and Benefits of the New Jersey Department of the Treasury.
