Any person, firm or corporation violating any provision of this chapter, where no other penalty is prescribed, shall be fined in an amount not to exceed $750 for each offense.

In addition to the penalty provided in § 240-33, any person, firm or corporation violating any of the parking regulations of the City of Lexington shall be fined in an amount not to exceed $750 for each offense.

Whenever any motor vehicle without a driver is found parked or stopped in violation of any of the restrictions imposed by ordinance of this City or by state law, the officer finding such vehicle shall take its registration number and may take any other information displayed on the vehicle which may identify the user and shall conspicuously affix to such vehicle a traffic citation, on a form provided by the City, for the driver to answer to the charge against him/her within seven days during the hours and at a place specified in the citation.

If a violator of the restrictions on stopping, standing or parking under the traffic laws or ordinances does not appear in response to a traffic citation affixed to such motor vehicle within a period of seven days, he/she shall be sent a certified letter notifying him/her that the amount as stated on the citation has been doubled, and if the violator does not respond to the receipt of the certified letter within a period of 10 weekdays, a warrant of arrest will be issued.

A. 
In any prosecution charging a violation of any law or regulation governing the standing or parking of a vehicle, proof that the particular vehicle described in the complaint was parked in violation of any such law or regulation, together with proof that the defendant named in the complaint was at the time of such parking the registered owner of such vehicle, shall constitute in evidence a prima facie presumption that the registered owner of such vehicle was the person who parked or placed such vehicle at the point where, and for the time during which, such violation occurred.
B. 
The foregoing stated presumption shall apply only when the procedure as prescribed in §§ 240-35 and 240-36 has been followed.

A. 
It shall be the duty of the officers of the Police Department to enforce all street traffic laws of the City and all of the vehicle laws applicable to street traffic in the City.
B. 
Officers of the Police Department are hereby authorized to issue ordinance violation citations to all offenders.

C. 
Said ordinance violation citation shall indicate to the offender the nature of the charge and ordinance number, the place of the offense and the fine and shall notify the offender that said fine may be paid at the Lexington Police Department and that a failure to pay the amount of the fine by the 10th weekday after issuance of the citation will result in the offer to pay the fine being withdrawn, and court action may thereafter be initiated by the City Attorney.
D. 
The Police Department shall collect all fines and remit same to the City Collector, and in the event the offender does not pay the fine by the 10th weekday deadline, the matter shall be referred to the City Attorney for prosecution.
