A.
It has been determined that the presence of pet waste near Township
water bodies causes nonpoint source pollution, which is inimical to
the general welfare.
B.
It is the purpose of this article to prevent conduct that allows
such pet waste to collect on any public thoroughfare, thereby reducing
nonpoint source pollution from stormwater runoff to Township lakes
and streams.
A.
No person, owning, harboring, keeping or in charge of any dog shall
cause, suffer or allow such dog to soil, defile, defecate on or commit
any nuisance on any common thoroughfare, sidewalk, passageway, bypath,
play area, or any place where people congregate or walk, or upon any
Township property whatsoever, or upon any private property without
the permission of the owner of said property.
B.
The restriction in this section shall not apply to curbing as hereinabove
defined, subject, however, to the following conditions:
(1)
The person who so curbs such dog shall immediately remove all feces
deposited by such dog by any sanitary method.
(2)
The feces removed from the aforementioned designated areas shall
be disposed of by the person owning, harboring, keeping or in charge
of any dog curbed in accordance with the provisions of this article
in a sanitary manner, such as discarding the sealed container or sealed
plastic bag in such person's garbage can.
This article shall be enforced by the State Police.
Any person who is guilty of failure to curb a dog shall be punished
by a fine of not less than $5, and not more than $500.
