The Warren County Social Services Board, operating as an administrative board under the authority of § 63.2-302 of the Code of Virginia (1950), as amended, prior to the date of the adoption of this chapter, is hereby disestablished, disbanded and revoked of authority and office, effective upon the appointment of members of a Warren County Social Services Advisory Board as provided under § 54-6 herein.
Pursuant to § 63.2-302 of the Code of Virginia (1950), as amended, the County Administrator is hereby designated to be the local board of social services.
There is hereby established a Department of Social Services, which shall consist of a Director of Social Services and such employees as may be provided by law or regulations.
The Department of Social Services shall be responsible for exercising the duties imposed upon such departments by the Code of Virginia.
The Director of Social Services shall be appointed by the County Administrator to be the administrative head of the Department of Social Services.
The Director shall be a person trained and experienced in social services administration.
The Director shall have general management and control of the Department of Social Services, including the making of rules and regulations, consistent with the ordinances of the County and the Code of Virginia for the conduct of the business of the Department.
There is hereby created the Warren County Social Services Advisory Board ("the Board"), pursuant to the provisions of § 63.2-305 of the Code of Virginia (1950), as amended.
The Board shall consist of five members who must be residents of Warren County. The County Administrator shall be an ex officio member without voting privileges.
The Board members shall be appointed by election districts. Expiration of the initial term for the appointments from the Fork and Happy Creek election districts shall be from the effective date of this chapter to December 31, 2010; from the North River election district shall be from the effective date of this chapter to December 31, 2011; from the Shenandoah election district shall be from the effective date of this chapter to December 31, 2012; and from the South River election district shall be from the effective date of this chapter to December 31, 2013. After the initial terms of office for each member, all terms shall be four years each, except that appointments to fill vacancies shall be for the balance of such unexpired term. No person shall serve more than two consecutive terms. Notwithstanding, a member shall remain as a member, unless otherwise removed, until a successor is named.
The members of the Board shall serve with such compensation as the Board of Supervisors shall approve and appropriate annually.
The Board shall elect one of its members as Chairman, and Vice Chairman, who shall serve for one year or until reelected or until his successor is elected.
The Board shall meet at least bimonthly. In addition to regularly scheduled meetings, the Board may meet at the call of the Chairman or on the petition of at least 1/2 of its members. The Board shall adopt rules of procedure and bylaws for the transaction of its business.
Any member who misses more than three consecutive regularly scheduled meetings without the permission of the Chairman shall forfeit the appointment and a vacancy shall be created.
The Board shall act in an advisory capacity to the County Administrator with respect to the duties and functions imposed upon him by Title 63.2 of the Code of Virginia (1950), as amended.
The powers and duties of the Board shall be as provided in § 63.2-305 of the Code of Virginia (1950), as amended, and shall include:
To interest itself in all matters pertaining to public assistance and social services for the people of the County;
To monitor the formulation and implementation of social services programs in the County;
To meet with the Director of the Department of Social Services at least four times per year for the purpose of making recommendations on policy matters concerning the Department;
To make an annual report to the Board of Supervisors, concurrent with the budget presentation of the Department of Social Services, concerning the administration of social services programs in the County; and
To submit to the Board of Supervisors, from time to time, other reports that the Board deems appropriate.
If any portion of this chapter shall be declared invalid by a competent court of law, such invalidity shall not affect the validity of any of the remaining provisions of this chapter.
