As used in this Part 12A, the following terms shall have the meanings indicated:
PORTABLE STORAGE UNITS
Portable storage devices, dumpsters, trailers, PODS or any other similar containers (hereinafter referred to as "PSUs") that are loaded with materials and placed on a residential property for purposes of temporary storage, including but not limited to household goods and building materials (prior to being used for building purposes), and for any other storage on a limited basis on a property which is either zoned residential or used primarily for residential purposes. Such units shall not be considered an accessory structure as provided under the Code of the Borough of Conshohocken.

1. 
Prior to the placement of any PSU on any residential property in Conshohocken Borough, the owner of such property must apply for and obtain a permit for the placement of such PSU from the Borough of Conshohocken Code Enforcement Office.
2. 
All applications for permits under this section must be accompanied by an insurance certificate providing liability insurance in an amount not less than $100,000 in general liability coverage from the owner of the property or the company supplying the PSU.
3. 
The Borough shall collect an application fee for any permit issued hereunder, in an amount to be fixed by resolution of the Council, for a thirty-day permit, subject to adjustment, from time to time, by resolution of the Council as provided hereunder.[1]

Permits issued under this section, and any renewal of permits issued hereunder, must be signed by the Code Enforcement Officer and prominently displayed on the PSU for which the permit is issued, in a sealed and watertight manner, so as to protect the permit from denigration by the weather, rain or other elements.

Initial permits may be granted for a period of five business days by the Code Enforcement Office, upon proper submission of the required application and supporting documentation as provided under § 13-1202.
2. 
After the expiration of the five business day period for the initial permit, an applicant may submit, upon valid cause shown, a renewal application for an additional five business days, which same application shall not be unreasonably refused by the Code Enforcement Office. All such applications for extension of a permit must be accompanied by an extension fee in an amount to be fixed by resolution of the Council, which same fee may be adjusted, from time to time, by further resolution of the Council.
3. 
No more than two extensions may be granted for any permit issued under this Article A (for a total of 15 business days) unless the property owner can produce a valid building permit for residential construction, issued by the Borough of Conshohocken Code Enforcement Office, in which case permits issued hereunder may be renewed every 30 days for a period not to exceed expiration of the building permit.

No residential parcel under this section may be issued more than two permits for the placement of a PSU during any twelve-month period. Such limitations shall include applications for extension. The total number of days upon which any PSU may be located on any residential property within the Borough shall not exceed 60 days unless otherwise provided under § 13-1203 of this Part 12A.

Upon a finding by the Code Enforcement Office that a parcel of property has experienced a flood, fire, natural disaster or other act of God, so as to render the primary residential dwelling thereon uninhabitable, and to require, in the judgment of the Code Official, the placement of a PSU on the property for a period longer than that provided under § 13-1204, the Code Enforcement Officer may issue an extended hardship permit under this section for the placement of a PSU for such period of time as fixed by the Code Enforcement Officer and not otherwise subject to the limitations provided under § 13-1204, the Code Enforcement Officer may issue an extended hardship permit under this section for the placement of a PSU for such period of time as fixed by the Code Enforcement Officer and not otherwise subject to the limitations provided under § 13-1204. All such extended hardship permits must be duly registered with the Code Enforcement Office and shall be issued without application fee.
2. 
Any permit issued under this section shall expire upon issuance of a permit under § 13-1203, Subsection 3.

All PSUs must be kept in the driveway of the property at the furthest accessible point from the street. All locations must be paved off-street surfaces, and the applicant must obtain preapproval of the Code Enforcement Officer for placement of a PSU. In the event a parcel is devoid of a driveway or other paved surface, placement of the PSU shall be at the direction of the Code Enforcement Official.

Only one PSU may be placed on any one residential property at one time. The Code Enforcement Officer is authorized to permit the placement of more than one PSU under the terms of § 13-1205 in the event that the circumstances giving rise to the hardship permit warrant the placement of additional home PSUs in order to accommodate the storage of interior furnishings, goods and materials from a residence substantially damaged by flood, fire, act of God or other natural disaster.

Any person who shall place a PSU in violation of this Part 12A shall, upon conviction before a Magisterial District Judge, be sentenced to pay a fine not exceeding $1,000, together with the cost of prosecution, and, upon default from the payment thereof, may be sentenced to undergo imprisonment for a period not exceeding 30 days. Each day in which a violation shall continue after due notice to the property owner shall be deemed a separate offense, punishable by the terms and conditions provided under this section.
2. 
The Code Enforcement Officer of the Borough of Conshohocken is duly empowered to enforce the terms, conditions and provisions of this Part 12A.

As used in this Part 12B, the following terms shall have the meanings indicated:

No PSU may be parked, placed or stored on a public street or Borough right-of-way without a valid permit.
2. 
All persons desiring to place a PSU on a public street or right-of-way with the Borough of Conshohocken are responsible for securing the appropriate right-of-way and public use permit required by the Borough. This permit is to be secured prior to the commencement of any work on a specific project and prior to the placement of any PSU on any street or right-of-way.
3. 
Permits shall remain valid for a period not to exceed five business days. Permits may be extended for valid cause by the Code Official for an additional period of five business days.
4. 
Nor more than two extensions pursuant to § 13-1212, Subsection 3, may be granted, and therefore the maximum period for any permit issued pursuant to this section is 15 business days.
5. 
No permit or extension permit shall be issued without payment to the Borough in an amount determined by Council. This fee shall be fixed, from time to time, by resolution of the Borough Council.

The company providing the PSU, any contractor utilizing a PSU, or any homeowner if no contractor has been engaged to perform services or work shall be responsible for any and all damage to any public street, sidewalk, curb, the public right-of-way, and any public improvements and any publicly owned equipment which may result from the placement, service, operation, use or removal of the PSU. Any and all dumpsters which may be proposed to be located within the public streets or rights-of-way shall be emptied when full and kept in a safe and secure condition, free of pests or other contaminations.

No PSU may be placed within 30 feet of any intersection or driveway.
2. 
No PSU over 60 inches in height or 72 inches in width may be placed within 150 feet of any intersection or driveway.
3. 
No PSU may be placed in any metered parking location within the Borough without the prior written approval of the Police Chief of the Borough of Conshohocken and the payment of any additional fees as determined necessary and appropriate by the Police Department.
4. 
The Borough of Conshohocken reserves the right to order the immediate removal and/or to unilaterally rescind the permit for placement of any PSU in the event of a public snow or other emergency.
