§ 15-401 Vehicles to be Parked Within Marked Spaces.

Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this Part for any person to park a vehicle or allow it to remain parked otherwise.

§ 15-402 Parking Prohibited at All Times in Certain Locations.

§ 15-403 Parking Prohibited In Certain Locations, Certain Days and Hours.

It shall be unlawful for any person to park, or to allow to remain parked, on any of the following streets or parts of streets, any vehicle other than a passenger car (which shall not include any bus, motor home or passenger car attached to a trailer of any kind).

§ 15-406 Special Purpose Parking Zones Established; Parking Otherwise Prohibited.

§ 15-407 Standing or Parking on Roadway for Loading or Unloading.

It shall be unlawful for any person to stop, stand or park a vehicle (other than a pedalcycle) on the roadway side of any vehicle stopped or parked at the edge or curb of any street, except that standing or parking for the purpose of loading or unloading persons or property shall be permitted on the following-named streets on Monday through Saturday, between the hours of 9:00 a.m. and 11:30 a.m. and between the hours of 1:30 p.m. and 4:00 p.m., and for no longer than necessary for the loading or unloading.

§ 15-408 Angle Parking Required on Portions of Certain Streets.

Only angle parking shall be permitted on the following portions of streets:

§ 15-409 Residential Permit Parking.

Findings and Purpose. The Borough finds that:

Certain residential areas in the Borough are subjected to commuter vehicle parking, therefore depriving the residents of those areas of spaces in which to park their own vehicles;

Those residential streets are also subjected to a high degree of commuter traffic which substantially reduces the quality of the ambient air level; and

The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Borough considers it to be in the interest of the people of the Borough to provide for the establishment of a residential permit parking program to insure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.

Definitions. For the purpose of this Section, words and terms listed in this subsection, as follows, shall have the following meanings:

COMMUTER VEHICLE

A motor vehicle parked in a residential area by a person not a resident of that residential area.

RESIDENT

A person who owns or leases real property within a residential area and who maintains a bona fide occupancy at that address.

PERMIT PARKING DISTRICT

A contiguous or nearly contiguous area where curbside parking on public highways is limited to not more than two consecutive hours between 6:00 a.m. until 12:00 midnight from Monday through Friday, except on legal holidays, unless the vehicle properly displays a parking permit authorized by the Borough; provided, however, that when actual commercial use of property on the ground floor level of any block of a street exceeds 50%, that block shall be excluded from the provisions of this Chapter.

PARKING PERMIT

Either a resident parking permit or a temporary parking permit authorized by the Borough.

RESIDENTIAL AREA

A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and non-business property (such as schools, parks, places of worship, hospitals and nursing homes).

VEHICLE

An automobile, motorcycle, van or jeep, but does not mean a truck, trailer or camper.

Designation of Districts. The Council may by resolution from time to time designate permit parking districts when it determines that residents of the proposed permit parking district are adversely affected by entry into the area and curbside parking by nonresidents in motor vehicles and/or by parking regulations in effect which are designed to control use of curbside parking but work a hardship on area residents, after taking into consideration the following:

The difficulty or inability experienced by residents of the proposed permit parking district in obtaining curbside parking reasonably accessible to their residences.

The likelihood of alleviating, by use of a permit parking system designated pursuant to this Part, the problem of lack of available curbside parking for residents of the permit parking district.

The desire of the residents of the proposed permit parking district for the institution of a permit parking system and the willingness of those residents to bear the costs incidental to the issuance of parking permits and administration of a permit parking system authorized by this Chapter.

The access to the area by means of transportation other than private vehicles.

The availability of off-street parking facilities.

The desirability of establishing a permit parking district in view of the proportion of actual residential use to other uses in the proposed permit parking district.

The resident parking permit will be valid for one year from June 1 until May 31 of the following year.

Permit parking districts are to be enumerated from time to time by Borough Council, as necessary and by resolution.

Posting of Signs. Upon designation by Council of a permit parking district, the Department of Streets shall erect signs which shall be of such a character as to inform an ordinarily observant person of the restrictions.

Issuance of Resident Parking Permits.

Subject to the provisions of subsection (5)(B), (C), (D) and (E) of this Section, the Borough or its designee shall issue to an applicant who has submitted a permit fee of $15 and a completed permit application form for one resident parking permit for the vehicle described in the application. This permit fee may be adjusted from time to time by resolution of Borough Council.

Except as provided in subsection (5)(E) of this Section, no resident parking permit shall be issued for a vehicle when its owner and principal operator does not reside within the permit parking district for which the resident parking permit is sought.

Except as provided in subsection (5)(E) of this Section, no resident parking permit shall be issued for a vehicle when the applicant is not the owner and principal operator of that vehicle.

Except as provided in subsection (5)(E) of this Section, a resident parking permit shall not be issued for a vehicle which does not display valid Pennsylvania license plates and is not registered to the home address of the applicant.

The provisions of subsection (5)(B), (C) and (D) of this section may be waived when an applicant establishes to the satisfaction of the Borough or its designee that he or she is a resident of the permit parking district for which a permit is sought, that he or she is the principal operator of the motor vehicle for which a permit is sought, and that the vehicle is either a leased vehicle or a company car supplied to the applicant by his or her employer for general use.

Fees may be changed from time to time as designated by the Borough Council by appropriate resolution.

Expiration of Residential Parking Permits. Residential parking permits shall not require renewal. Residential parking permits shall automatically expire when the residential permit holder no longer resides at the address for which the permit was issued. Residential parking permits may not be transferred to a new resident moving into an address for which a residential parking permit has been issued. New residents shall apply for a new permit. There shall be no cost to replace or renew the residential parking permit to a new vehicle registered to the same person at the same address.

Use of Resident Parking Permits.

All resident parking permits shall be displayed in or on vehicles in the manner prescribed by the Borough Council or its designees.

A parking permit shall not guarantee or reserve a parking space within a permit parking district. A parking permit shall not authorize the stopping, standing or parking of any vehicle in such places and during such times as the stopping, standing or parking of vehicles is prohibited or set aside for specific types of vehicles. A parking permit shall not excuse the observance of any traffic regulation other than the two-hour maximum parking limit enforced in the permit parking district and the necessity for depositing fees in parking meters.

Whenever the holder of a parking permit or the vehicle for which the permit was issued no longer fulfills one or more of the applicable provisions of this Section, or any resolutions enacted thereto, the holder shall surrender the parking permit in the manner prescribed by the Borough or its designees.

Until its expiration, surrender or revocation, a parking permit shall remain valid for such time as the holder continues to reside within the same permit parking district.

A parking permit shall be valid only in the permit parking district for which it is issued; except in the case of overlapping districts as set forth in this Section or subsequent resolution.

For the purposes of this Section, the person to whom a parking permit is issued shall be deemed its holder and shall be responsible for the use or misuse of any parking permit issued to him or her.

Revocation of Permits. The Chief of Police shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this Section. Upon written notification to him of the revocation., the permit holder shall surrender the permit to the Chief of Police. Failure to do so, when so requested, shall constitute a violation of this Section. Provided, any person receiving such a notice may, within 10 days after the date of the notice, appeal to the Borough Council for a hearing on the revocation, and the decision of the Borough Council shall be final.

Exemption for the Physically Disabled. The provisions of this Chapter shall in no way supersede the provisions of the Borough Code or resolution enacted by Council relating to parking by physically disabled persons.

Rules and Regulations.

In the form of a resolution the Borough Council shall promulgate by rules and regulations relating to the implementation and enforcement of the provisions of this Chapter and resolutions pertaining thereto.

When promulgating rules and regulations, the Council or its designee shall make every reasonable effort to devise methods to preserve the integrity of the permit parking system.

Penalties. Any person, firm or corporation who shall violate any provision of this Section shall, upon conviction thereof, be sentenced to pay a fine of not less than $100 and no more than $1,000, plus costs and attorneys' fees, and, in default of payment of such fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation continues shall constitute a separate offense.

§ 15-410 Overnight Parking of Certain Trucks, Trailers and Equipment and Vehicles Prohibited.

It shall be unlawful to park any tow truck, dump truck, tractor, recreational vehicle, step-up or box van, mobile construction equipment (except mobile construction equipment that is in the process of performing street, road or construction work), or any vehicle with a registered gross vehicle weight rating in excess of 11,000 pounds on any street or portion thereof in the Borough of Conshohocken for a continuous period of more than two hours between the hours of 9:00 p.m. and 7:00 a.m., prevailing time.

The restrictions of this § 15-410, Subsection 1, shall not apply to any trucks, trailers, equipment or vehicles with a registered gross weight in excess of 11,000 pounds that are parked on boundary streets with neighboring municipalities, provided that the truck, trailer, equipment or vehicle with a registered gross weight in excess of 11,000 pounds is not parked on the Borough of Conshohocken side of the street (i.e., is not located in the Borough).

The restrictions of § 15-410, Subsection 1, shall not prohibit the parking of pickup trucks which may exceed 11,000 pounds on Borough streets where such vehicles are not modified or adapted to fit the class of vehicles prohibited under § 15-410, Subsection 1, and that does not violate the restrictions of § 15-410, Subsection 2.

In addition to the restrictions of § 15-410, Subsection 1, it shall be unlawful to park any vehicle with the following characteristics or trailer with the following characteristics on any street or portion thereof in the Borough of Conshohocken for a continuous period of more than two hours between the hours of 9:00 p.m. and 7:00 a.m., prevailing time:

Any vehicle larger than 22 feet in length or nine feet in width, or, if the street on which the vehicle is parked has demarcated parking spaces, larger than the demarcated parking space, i.e., the vehicle shall be parked wholly within the lines or markings, and it shall be a violation of this Part for any person to park a vehicle across any such line or marking, or to park a vehicle in such a position that that vehicle is not wholly within the area designated by those lines or markings.

Any trailer, semitrailer, house trailer, boat trailer, any type of trailer camper whether attached to a vehicle or alone, regardless of size or weight.

§ 15-410.1 Parking Prohibited in Fire Lanes.

Fire Lane Defined. A "fire lane" is defined as that part of a road (public or private), parking lot, other passageway, or other area designed to allow the passage of, or access by, a fire apparatus. A fire lane is not necessarily intended for vehicular traffic other than fire apparatus.

Parking Prohibited in Fire Lanes. No parking, standing or stopping shall be permitted at any time on any fire lane, and no parking shall be permitted in any location which would prevent access to any fire lane by any emergency vehicle. A lane marking shall be placed on the pavement identifying the fire lane to warn people against blocking the lane. No person shall park, stand or stop a vehicle or let a vehicle park, stand or stop on any fire lane at any time, and no owner, manager, supplier, deliveryman or tenant of any premises shall permit any customer or visitor to park any vehicle or permit any vehicle to park, stand or stop on any part of any fire lane at any time.

§ 15-411 Violations and Penalties.

Any person who violates any provision of §§ 15-401, 15-402, 15-403 or 15-408 shall pay a fine of not more than $20 and, in default of payment thereof, may be cited and upon conviction shall pay the required fine plus costs.

Any person who violates any provision of §§ 15-404, 15-405, 15-406 or 15-407 shall pay a fine of not more than $35 and, in default of payment thereof, may be cited and upon conviction shall pay the required fine plus costs.

Any person who violates any provision of § 15-410 shall pay a fine of not more than $100 and, in default of payment thereof, may be cited and upon conviction shall pay the required fine plus costs.
