Nonrecyclable garbage, refuse, rubbish and ashes shall be collected by the Department of Public Works at such hours as may be provided from time to time by the Board, and it shall be the duty of residents in such areas to make such nonrecyclable ashes, refuse, rubbish and garbage available at the curbline in front of premises within the Village, at such time for removal as hereinafter provided.
A. 
Garbage containers shall be no larger than 35 gallons in size, and shall be made of metal, plastic or rubber, watertight, with tight-fitting covers, equipped with bails or handles for easy handling. A garbage container cover shall not be tied, chained or otherwise tethered to the garbage container.
B. 
Ash containers shall be of metal or sturdy construction, with adequate handles for handling and to prevent spillage.
C. 
Rubbish containers shall be of a type suitable for the material therein deposited. Such containers should preferably be of plastic or metal, but baskets, burlap or cloth bags, plastic containers and bags may be used for light rubbish such as leaves, etc. Rubbish that cannot readily be placed in containers shall be reduced in volume as much as possible and securely tied to permit safe and speedy handling.
The combined weight of any container and its contents shall not exceed 60 pounds.
Containers shall be maintained clean and in good condition. Any container that does not conform to the provisions of this article, or that may have ragged or sharp edges or any other defect liable to hamper or injure the persons collecting the contents thereof, must be promptly replaced by a proper receptacle upon receipt of notice to that effect from the Superintendent of Public Works, and if not so replaced within 10 days after the receipt of such notice, such nonconforming or defective container may be collected and disposed of as waste.
An adequate number of containers shall be provided for each of the several classes of refuse as herein defined, to properly store such refuse until the regularly scheduled collection time.
Ashes, rubbish, garbage or other refuse not placed in containers, as aforesaid, or not conforming to the regulations hereinbefore set forth shall not be placed upon the curbline for collection but shall be removed either at the owner's expense or by special arrangement or agreement with the Department of Public Works and in conformity with instructions in each particular case.
No dead animals or parts thereof shall be placed in any garbage container or dumpster.

A. 
Collection at multiresidential complexes. Notwithstanding any other provision of this article, the following regulations shall apply to multiresidential complexes:
(1) 
All garbage and other refuse must be placed in fully enclosed containers or dumpsters and stored in an enclosure made of an acceptable solid fence or other solid material, the location of which must be approved by the Superintendent of Public Works.
(2) 
No garbage or other refuse shall be stored or placed at the curb for collection except in fully enclosed containers, dumpsters or heavy-duty black plastic bags with a minimum thickness of three millimeters and shall not be placed at the curb before sundown of the day before collection and must be returned to the storage enclosure no later than 4:00 p.m. of the day of collection.
(3) 
It shall be the responsibility of the property owner or the management company of the multiresidential complex to provide adequate storage containers and facilities and to otherwise ensure that the occupants in the multiresidential complex comply with this article.
(4) 
Under no circumstances shall light-duty plastic, paper, burlap, cloth or other soft, pliable bags be stored or placed outside of any commercial building except in fully enclosed rigid containers or dumpsters.
B. 
Collection at commercial establishments except restaurants or other food-related establishments. Notwithstanding any other provision of this article, the following regulations shall apply to commercial establishments except restaurants or other food-related establishments:
(1) 
All garbage and other refuse must be placed in fully enclosed rigid containers, dumpsters or heavy-duty black plastic bags with a minimum thickness of three millimeters and stored in a location approved by the Superintendent of Public Works.
(2) 
The location for collection by the Department of Public Works shall be determined by the Superintendent of Public Works. No garbage or other refuse shall be stored or placed for collection except in fully enclosed containers, dumpsters or heavy-duty black plastic bags with a minimum thickness of three millimeters and shall not be placed before sundown of the day before collection and must be returned to the storage area no later than 4:00 p.m. on the day of collection.
(3) 
Under no circumstances shall light-duty plastic, paper, burlap, cloth or other soft, pliable bags be stored or placed outside of any commercial building except in fully enclosed rigid containers or dumpsters.
C. 
Collection at restaurants and other food-related establishments. Notwithstanding any other provision of this article, the following regulations shall apply to restaurants and other food-related establishments:
(1) 
All food-related garbage and other refuse must be placed in a waterproof plastic bag, tied or otherwise sealed to prevent leakage of its contents, and then placed in fully enclosed rigid containers or dumpsters and stored in a location approved by the Superintendent of Public Works.
(2) 
The location for collection by the Department of Public Works shall be determined by the Superintendent of Public Works. No garbage or other refuse shall be stored or placed for collection except in fully enclosed containers or dumpsters and shall not be placed before sundown of the day before collection and must be returned to the storage area no later than 4:00 p.m. on the day of collection.
(3) 
Under no circumstances shall light-duty plastic, paper, burlap, cloth or other soft, pliable bags be stored or placed outside of any restaurants or other food-related establishments except in fully enclosed rigid containers or dumpsters.
D. 
Dumpsters required. Any multiresidential complex or commercial establishment which, in the determination of the Superintendent of Public Works, produces excessive garbage shall be required to obtain a dumpster. The dumpster shall be placed on the property in a location determined by the Superintendent of Public Works and, in his discretion, hidden from public view by fencing, shrubbery or other enclosure.

A. 
No person shall prevent or interfere with any employee of the Department of Public Works in the sweeping or cleaning of any street or in the removal of sweepings, ashes, garbage, rubbish, snow, ice or other refuse material.
B. 
No person other than an authorized employee or agent of the Department of Public Works shall disturb or remove any ashes, garbage, light refuse or rubbish placed within the stoop or area line or in front of a property by a landowner, tenant or occupant of said property for removal, unless authorized by said landowner, tenant or occupant.
A. 
Any person who shall place garbage, refuse, rubbish or ashes at any curbline for collection, not contained in a suitable container as herein provided or in conformity with the directions of the Department of Public Works, shall be guilty of a violation of this article.
B. 
Any person who shall place or remove containers of garbage, refuse or ashes as herein provided in violation of § 161-14 shall be guilty of a violation of this article.
C. 
Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
