In accordance with the provisions of the Municipal
Home Rule Law and the Criminal Procedure Law, the following officers
and employees of the Village of East Rockaway shall have the power
to issue and serve appearance tickets in connection with the performance
of their duties in enforcing any statute, local law, ordinance, rule
or regulation. The issuance and service of such appearance tickets
shall have the same force and effect as if served by a peace officer.
A.
Superintendent of Construction.
B.
Deputy Superintendent of Construction.
C.
Building Department Inspectors.
D.
Superintendent of Building and Zoning.
E.
Superintendent of Public Works and designated employees
in the Department of Public Works.
F.
Village Clerk-Treasurer.
G.
Chief and Assistant Chiefs of the Fire Department.
H.
Auxiliary police officers.
I.
Parking Enforcement Officers.
J.
Code Enforcement Officers.
Appearance tickets shall be issued in compliance
with § 150.10 of the Criminal Procedure Law of the State
of New York.
A.
An appearance ticket issued and served pursuant to
this chapter for a violation of any of the ordinances, local laws,
resolutions or regulations of the Village of East Rockaway shall be
returnable in the Village Justice Court on the second Tuesday of any
month at 8:00 p.m. and shall be substantially in the following form.[1]

ticket is available and on file in the office of the Village Clerk.
B.
This appearance ticket shall be in triplicate, with
the original being served upon the defendant, the second copy sent
to the court, along with the accusatory instrument, and the third
kept in the files of the issuing office.
