[HISTORY: Adopted by the Town Board of the

This chapter shall be known as the "Law to Regulate
Parking and Standing of Vehicles."
It shall be the purpose of this chapter to lessen
congestion and promote the safe and efficient use of the highways
for the benefit of inhabitants and transients of the Town of Chautauqua.
A.
HIGHWAY
SUPERINTENDENT
As used in this chapter, the following terms shall
have the meanings indicated:
Any Town or county street, road or highway within the Town
of Chautauqua located outside the incorporated Village of Mayville
or Chautauqua Institution specifically designated by the Town Board
as subject to the restrictions or limitations of this chapter and
any state highway specifically designated by the New York State Department
of Transportation as subject to parking or standing restrictions.
The duly elected Town Superintendent of Highways for the
Town of Chautauqua or his duly appointed designee.
B.
All other terms used in this chapter shall, for the
purpose of this chapter, have the meanings respectfully ascribed to
them by Article 1 of the Vehicle and Traffic Law of the State of New
York.

A.
The parking or standing of vehicles is hereby prohibited
at any time in any of the following highway locations:
(1)
On both sides of Elmwood Road between the shoreline
of Chautauqua Lake and a point 700 feet northerly from the shoreline
of Chautauqua Lake.
(2)
On both sides of Galloway Road between the center
line of Elmwood Road and a point 500 feet easterly from the center
line of Elmwood Road.
(3)
On the south side of County Route No. 33 commencing
at the intersection of Route 394 to a point 1,375 feet southerly from
the intersection of Route 394.
(4)
On the north side of County Route No. 33 commencing
at the intersection of Route 394 to a point 1,500 feet southerly from
the intersection of Route 394.
(5)
On the easterly side of Meadows Road (formerly known
as "Mill Road") commencing at the intersection with State Highway
No. 430 southerly to the shore of Chautauqua Lake.
(6)
On the northerly side of County Road 127, commencing
at the intersection of State Highway Route 430 to a point 686 feet
easterly from the intersection of Route 430 and on the southerly side
of County Road 127, commencing at the intersection of State Highway
Route 430 to a point 646 feet easterly from the intersection of Route
430.
(7)
On the easterly side of County Route No. 29, known
as the "Plank Road," commencing 200 feet from the intersection of
County Route 54 (and Route 127) to a point 1,600 feet northerly from
the intersection of Route 54 (and Route 127).

commencing at the intersection of County Route Nos. 58, 127 and 54
to a point 80 feet northeasterly from the intersection of County Route
Nos. 58, 127 and 54.

at the intersection of County Route Nos. 58, 127 and 54 to a point

both sides of Beaujean Road between the center line of Route 394 and
a point 1630 feet southwesterly and westerly from the center line
of Route 394.

B.
The parking or standing of vehicles is hereby prohibited
between November 1 and April 15 on all Town highways.

Parking or standing of a vehicle in an area
of a highway for which parking or standing has been prohibited is
a violation constituting a traffic infraction punishable by a fine
of $50 for a first offense, $100 for a second offense and $150 for
all succeeding offenses.

A.
This section
shall apply only to Town highways in the Town of Chautauqua located
outside the incorporated Village of Mayville.
B.
For purposes
of this section, the term "vehicle" shall mean every device in, upon,
or by which any person or property is or may be transported or drawn
upon a road, except devices moved by human power or used exclusively
upon stationary rails or tracks.
C.
The Superintendent
of Highways shall have the power to cause the immediate removal from
the right-of-way of any Town highway of any vehicle which obstructs
or interferes with the use of such a highway for public travel; or
which obstructs or interferes with the construction, reconstruction
or maintenance of such a highway; or which obstructs or interferes
with the clearing or removal of snow or ice from such a highway; or
which obstructs or interferes with any operation of the Town of Chautauqua
Highway Department during a public emergency.
In addition to penalties authorized by this
chapter and the Vehicle and Traffic Law of the State of New York,
the Superintendent is hereby authorized and empowered to remove and
store, or authorized and empowered to cause to be removed and stored,
any vehicle parked in violation of this law. The Superintendent shall
not release any such vehicle so removed until the actual and necessary
costs of the removal, including towing and storage, shall have been
paid.
All prior local laws and resolutions of the
Town of Chautauqua regulating parking and standing of vehicles are
hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any local law or resolution hereby repealed prior
to the taking effect of this chapter.
