This article shall be applicable to all streets and roads within
the territorial limits of the Borough of Edgewater.

The Borough hereby designates all streets and roads within the territorial limits of the Borough as permit parking areas, as set forth in § 287-15 of this article, upon which resident vehicles displaying valid parking permits may stand or be parked without limitation by parking time restrictions established by this article, except as otherwise provided in § 287-21 of this article.

A.
Residential permit parking shall be in effect between the hours of
10:00 a.m. and 12:00 noon, weekdays, excluding holidays, on all streets
and roads within the territorial limits of the Borough to which this
article is applicable.
B.
In addition to the permit parking requirement of this section, no
vehicle shall be permitted to park for longer than two consecutive
hours on any street or road within the Borough without a residential
parking permit displayed on such vehicle.

This article shall have no applicability to metered parking
spaces within any designated facility or on any designated street
within the Borough. A residential parking permit shall not exempt
a resident when parked in a metered space from purchasing the time
from the meter at the established rate.

A.
Upon the adoption of this article, the Borough shall issue the appropriate
permits in accordance with this article. A permit shall be issued
to an applicant, provided proof of residency is established. An applicant
shall be required to produce his or her motor vehicle registration,
together with one of the following: driver's license, deed or
lease to property, voter registration identification, or any other
evidence that the party applying for the permit is a resident of the
Borough.
B.
Number of permits; multifamily developments.
(1)
One residential parking permit shall be issued for each person holding
a valid New Jersey driver's license at each residence.
(2)
Any resident who lives in a multifamily development which provides
for a parking space on site, whether it be as part of the base rent
or purchased with the unit, will only be permitted to obtain a residential
parking permit if a second licensed driver resides at the premises.
However, in any event, the parking spot on site must be occupied by
said vehicle before parking is permitted on the street.
C.
A residential parking permit shall be valid for up to two years from
the date of issuance (ending December 31 of the year following the
permit's issuance).
D.
Nonresident employees of valid businesses operating in Edgewater
will be able to obtain a nonresident employee parking permit that
will be good for the calendar year in which it is issued. The nonresident
employee must present a current driver's license and motor vehicle
registration along with valid proof of employment, such as a pay stub
or letter from the employer on the employer's letterhead. This
permit will include nonresident employers. No overnight parking shall
be permitted by anyone holding a nonresident employee parking permit.

A resident or Borough business employee vehicle on which is displayed a valid parking permit as provided for herein shall be permitted to stand or be parked without being limited by time restriction requirements established pursuant to this article; provided, however, that this unrestricted parking shall not be applicable to the Hilliard Avenue municipal parking lot, being known and designated as Lots 10 and 11 in Block 54 on the current Tax Assessment Map, and being more commonly known as 21 Hilliard Avenue. However, said resident or Borough business employee vehicle shall not be exempt from parking restrictions or prohibitions established pursuant to Title 39 of the New Jersey State statutes, or Chapter 432 of the Borough Code or the Borough ordinance for street sweeping or ordinance provisions pertaining to public safety and handicapped parking zones and other special parking restrictions established by law.
The restrictions on parking in designated residential areas
shall not apply to the following classifications of vehicles, provided
they are property marked:
A.
Contractor/service and delivery vehicles. Contractor, service and
delivery vehicles bearing the name and address of a commercial business
may park without permit during the times they are rendering service
within the Borough.
B.
Emergency and utility vehicles. Emergency vehicles, gas, electric,
telecommunications and other similar vehicles may park within the
Borough during the times they are rendering service or repairs within
the Borough.
C.
Health-care providers. May park their vehicles within the Borough
during the times they are rendering assistance and/or health-care
service to residents of the Borough (such health-care provider to
be defined as a nurse, home-health aid, physical therapist, or any
other medical professional).
It shall be unlawful and a violation of this article for a person
to copy, produce or otherwise bring into existence a facsimile or
counterfeit parking permit or alter an expired parking permit. It
shall further be unlawful and a violation of this article for a person
to knowingly use or display an altered, facsimile or counterfeit parking
permit in order to evade time limitations on parking. The person committing
the aforementioned act shall be subject to a penalty not to exceed
$1,000 and/or imprisonment for not more than 10 days for such violation,
such penalties to be imposed by the Municipal Court.
The provisions of this article shall be enforced by the Police
Department of the Borough of Edgewater.

If any such permit issued as defined in § 287-19 is used on any other vehicle or is used for a parking use other than that which it was specifically issued, a fine shall be levied and the permit revoked in accordance with the following terms:

The Borough of Edgewater be and hereby is authorized to prepare
and implement a parking program, in conjunction with the residential
parking permit program heretofore referred to, by or for employees
of owners or bona fide lessees of business premises operating within
the Borough, such employee parking permit program to be administered
by the Borough and enforced by the Police Department in accordance
with reasonable rules and regulations to be promulgated by the Borough
for such employee parking permit program, at a cost to be established
by the Borough.
In addition to all other enforcement authority, the Mayor and
Council shall have authority to enforce the provisions of the Uniform
Fire Code, insofar as same applies to fire lane violations, and police
personnel are hereby authorized to issue summonses for said fire lane
violations. Notwithstanding the foregoing, nothing contained herein
shall affect the enforcement jurisdiction of fire officials, police
personnel or any other governmental agencies with jurisdiction over
fire lane violations.
