No person shall engage in the operation of a livery/limousine,
hire out or keep or use for hire or pay, or cause to be kept or used
for hire or pay, any livery without first having obtained a license
for that purpose from the Borough Clerk. Each license shall entitle
the licensee to operate one livery in the Borough. There are no limits
to the number of livery/limousine licenses which may be obtained.
No livery shall be licensed until a policy of insurance shall
have been filed with the Borough Clerk in accordance with the provisions
of N.J.S.A. 48:16-1 to 48:16-22, inclusive, as now or hereafter amended
or supplemented. Such policy of insurance shall not be filed unless
it is approved by the Mayor and Council.
Licenses shall be issued by the Borough Clerk and shall be signed
by the Borough Clerk and in the name of the Borough.
The fee for a livery license shall be $100 annually.
All licenses shall expire on December 31 next succeeding the
date thereof, unless sooner suspended or revoked.
Each license may be transferred by the person to whom granted
to such other person or persons subject to the approval of the Mayor
and Council, and an application for such transfer shall be made on
a form prepared by the Borough for such purpose, which application
shall be accompanied by a transfer fee made payable to the Borough
of Edgewater in the sum as determined in the fee ordinance.
Notwithstanding the provisions of §
402-30 hereof, no limousine shall be licensed until an insurance policy or certificate in lieu thereof shall have been filed with the Borough Clerk with liability limits of not less than $100,000 to $300,000 for bodily injury and $10,000 for property damage.
For the purpose of regulating and for the purpose of clearly
distinguishing a limousine from a taxicab, it shall be unlawful for
any licensed limousine owner or licensed limousine driver, as herein
defined, to make a charge for transportation of one or more persons
at a minimal charge of less than $15. No rebates, participating coupons
or other inducement calculated to reduce rates shall be permitted.
Notification shall be sent to the owners of all limousine licenses
by the Borough Clerk by certified mail 30 days prior to the expiration
date of all limousine licenses. If no return receipt is received or
the license is not renewed within 15 days after the expiration date,
a second and final notice shall be sent notifying the limousine company
owner of the Borough's intention to deem abandoned any and all
licenses which have not been renewed within 30 days after the expiration
date.
No licensed livery may park in any public street or public place
in the Borough except in such place or places as may be designated
by ordinance, resolution or regulation adopted in accordance with
law. Only such taxicabs as are for hire may remain at designated taxicab
stands while waiting for employment. After the first taxicab in line
leaves the stand, those behind shall move forward. Any other taxicab
seeking parking space in such stand shall approach it only from the
rear thereof. All taxicabs shall contain therein a sign or sticker,
placed in a location to be within the view of the passenger, which
indicates that passengers are required to be discharged at curbside.
The license issued pursuant to this chapter may be suspended
or revoked by the Mayor and Council for any of the following causes,
whether arising out of the operation of a livery:
A. A violation of any provision of this chapter, any provision of any
other ordinance of the Borough of Edgewater or any of the laws of
the State of New Jersey.
B. The falsification of any information contained in the application
for a license.
C. Permitting or suffering any livery to be used for any illegal or
immoral purpose or purposes.
D. If the vehicle is found to be unsafe or unfit for public patronage.
E. If inspection discloses that the taximeter is not in proper working
condition or is operating inaccurately.
