A certain document, three copies of which are on file in the office of the Construction Code Official of the Borough of Edgewater, being marked and designated as the "BOCA National Property Maintenance Code, Third Edition, 1990," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Property Maintenance Code of the Borough of Edgewater, in the State of New Jersey, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Property Maintenance Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in §
314-2 of this chapter.
The BOCA National Property Maintenance Code is amended and revised
in the following respects:
A. In Section PM-100.1 (page 1, second line), insert: "Borough of Edgewater."
B. In Section PM-109.2 (page 7, third line), insert: "$100 nor more
than $2,000."
C. In Section PM-109.2 (page 7, fourth line), insert: 90 days."
D. In Section PM-302.12 (page 17, first line), insert: "May 15 to October
1."
E. In Section PM-601.1 (page 27, tenth line), insert: "October 1 to
May 15."
F. In Section PM-601.1 (page 27, eleventh line), insert: "70° F.
(20° C.)" in place of "65° F. (18° C.)."
G. In Section PM-601.2 (page 27, second line), insert: "October 1 to
May 15."

On all properties within the Borough grass and weeds shall be
trimmed to less than eight inches of height on all areas of a property.

A. When the enforcement officer determines that there has been a violation
of any provision of this chapter, he shall give notice of such violation
to the persons or entities having ownership or control of the subject
area where the violation exists. Such notice shall be given in writing
and shall be sent by certified mail and regular mail to the last known
address as evidenced by the most recent tax duplicate of the Borough.
B. The notice shall specify the nature of the violation and that unless
the same is removed, remedied or cured within 10 days of the date
of such notice, a summons shall be issued for the violation.
C. In addition, the notice shall further state that absent the violation
being eliminated, the Borough shall have the right to undertake the
removal of the violation by entering into a contract for the abatement
of the violation and may thereafter cause the same to be eliminated
or removed. The cost that the Borough incurs in having the violation
eliminated shall thereafter become a municipal lien on the subject
premises and shall be added to and become and form a part of the taxes
to be assessed and levied upon such property and shall bear interest
at the same rate as taxes and shall be collected and enforced in the
same manner.
