The Common Council of the City of Glens Falls finds it is in
the best interest of the citizens of Glens Falls, for the welfare,
safety and health thereof, to adopt New York State General Municipal
Law Article 19-A to govern the creation, extension and operation of
business improvement districts within the City of Glens Falls in order
to foster the commercial viability and attractiveness of commercial
districts. The Common Council recognizes that certain adjustments
to its regulations must be made from time to time in order to preserve
the health and safety of its residents while at the same time accommodating
and expanding the business community and encouraging economic growth.
The provisions of Article 19-A of the New York State General
Municipal Law (GML) are hereby applicable to the establishment, extension,
amendment, and operation of business improvement districts (BIDS)
within the City of Glens Falls.

The Central Business Improvement District of Glens Falls ("CBID")
shall be and is hereby established in the City of Glens Falls, the
Common Council having found that the establishment of the District
is in the public interest, that all notice, mailing and hearing requirements
have been complied with, that all properties within the District will
benefit from the establishment and that all property benefited is
included in the boundaries of the District. The boundaries of said
District are contained in the district plan adopted by the Common
Council on September 23, 2004, by Resolution No. 299, and are set
forth in Exhibit A attached hereto.
The CBID is governed by a not-for-profit corporation, the Central
Business Improvement District Management Association, Inc., embodying
a Board of Directors consisting of three appointed members, seven
property owners owning property within the CBID and one commercial
tenant within the CBID.
The improvements and provisions of services within the District
shall be pursuant to such district plan of the CBID. All said services
shall be in addition to, and not a substitution for, required municipal
services provided by the City of Glens Falls on a City-wide basis.
The cost of services provided within the CBID shall be levied
against the benefited real property within the boundaries of the CBID,
except as provided in § 980-a of the General Municipal Law
and shall be levied and collected in the same manner and at the same
time and by the same officers as general municipal taxes are levied
and collected within the City. The CBID assessment shall be assessed
upon the benefited real property pursuant to the district plan.
Any amendments to the CBID or the district plan shall be made
in accordance with the provisions set forth in § 980-i of
Article 19-A of the General Municipal Law.
This article shall become effective upon compliance with the
requirements set forth in § 980-g of Article 19-A of the
General Municipal Law.
