Such conduct has the purpose or effect of substantially interfering
with work performance or creates an intimidating, hostile or offensive
work atmosphere.
"Harassment," as defined herein, refers to behavior that is not welcome;
is personally offensive; fails to respect the rights of others; lowers
morale; or interferes with work performance.
Nonverbal. Dissemination of offensive objects or pictures, graphic
commentaries, suggestive or insulting sounds, obscene gestures, leering
or whistling.
Physical. Unwanted physical contact, pinching, pushing, assault or
violent activity.
All forms of harassment, unwelcome advances, requests for unusual
favors and/or other verbal or physical conduct intended to coerce
another person to act in a manner contrary to that person's beliefs
are prohibited.
If an employee believes he or she has been subject to harassment,
the employee should immediately notify his or her supervisor or the
Personnel Committee.
The Personnel Committee shall, within 48 hours, investigate the complaint.
Such investigation will remain, to the maximum extent feasible, confidential,
on a strict need-to-know basis. Should the investigation reveal that
sexual harassment has occurred, the Mayor and Council shall take immediate
steps to ensure that such conduct does not reoccur.
The Mayor and Council shall see that the appropriate disciplinary action is taken against any party found to have violated this article. Discipline shall follow the procedures described in this chapter and may take any of the forms set forth in § 46-85.
Any employee found to have engaged in harassment shall be subject
to discipline as provided by the Code of the Township of Allamuchy,
including termination from employment. Any elected official found
to have engaged in harassment shall be publicly censured. Any member
of the public found to have engaged in harassment of the Township
employee or elected official of the Township shall be prosecuted to
the fullest extent permitted by law.
