1. The Township hereby elects to administer and enforce the provisions
of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S.
§ 7210.101 et seq., as amended from time to time, and its
regulations.
2. The Township hereby elects to adopt and incorporate, by reference,
the Uniform Construction Code, contained in 34 Pa. Code, Chapters
401- 405, as amended from time to time.
3. The Township hereby adopts certain provisions that exceed the requirements
of Sections 403.1(b) and 403.62(c) of the Pennsylvania Construction
Code as the Residential Code of the Township and as part of the Municipal
Building Code of Upper Macungie Township, as follows:
A. Permits shall be required for the following:
(1)
Interior alterations/repairs.
(2)
Removal/replacement of roofing.
(3)
Finish space or create additional living space in a basement.
(4)
Install/remove/replace furnaces, hot-water heaters, HVAC units.
(5)
Install/upgrade electrical wiring.
(6)
Installation of a generator.
(7)
Remove/replace electrical panel boxes.
(8)
Upgrade/repair electrical service.
(9)
Replace swimming pools and install swimming pool decks.
(10)
Install/replace decks over 200 square feet, railings, or stairs.
(11)
Detached accessory structures exceeding 500 square feet in size.
(12)
Install subpanels/wiring to a detached accessory structure.
4. Climatic and Geographic Design Criteria to be inserted into and made
a part of Table R301.2(1) of the International Residential Code:

5. Administration and enforcement of the code within the Township shall
be undertaken in any of the following ways, as determined by the governing
body of the Township from time to time by resolution:
A. By the designation of an employee of the Township to serve as the
municipal code official to act on behalf of the Township;
B. By the retention of one or more construction code officials or third-party
agencies to act on behalf of the Township; or
C. By agreement with one or more other municipalities for the joint
administration and enforcement of this Act through an intermunicipal
agreement.
6. A Board of Appeals shall be established by resolution of the governing
body of the Township in conformity with the requirements of the relevant
provisions of the code, as amended from time to time, and for the
purposes set forth therein. If at any time enforcement and administration
is undertaken jointly with one or more other municipalities, said
Board of Appeals shall be established by joint action of the participating
municipalities.

It is declared that the enactment of this Part is necessary
for the protection of life, health, property and the environment and
for the safety and welfare of the consumer, general public and the
owners and occupants of buildings and structures within the Township.

1. All building code ordinances or portions of ordinances inconsistent
herewith which are in effect as of the effective date of this Part
shall be and the same expressly are repealed.
2. All relevant ordinances, regulations and policies of the Township
not governed by the code shall remain in full force and effect.

Fees assessable by the Township for the administration and enforcement
undertaken pursuant to this Part and the code shall be established
by the governing body by resolution from time to time.
