A certain document, copies of which are on file in the offices of the Township of Upper Macungie and available for public use, inspection and examination for at least seven days before the adoption of this code, being marked and designated as the "2015 International Property Maintenance Code," or latest edition, as published by The International Code Council, Inc., be and is hereby adopted as the Property Maintenance Code of the Township of Upper Macungie in Lehigh County, Commonwealth of Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of the said 2015 International Property Maintenance Code, or latest edition, are hereby referred to, adopted and made a part hereof, as if fully set out in this Part, with the additions, amendments, insertions, deletions, modifications, and changes, if any, prescribed below in this Part.

The following insertions and modifications shall be made in the Property Maintenance Code at the places hereinafter indicated:
A. 
Subsection IPM-101.1 Title: Insert at space indicated for "(NAME OF JURISDICTION)": "Upper Macungie Township."
B. 
Subsection IPM-106.4 Violation Penalties: Modify to:
"Any person who is found by the District Justice to have violated a provision of this Code, or to have failed to comply with any of the requirements thereof, or who has erected, constructed, altered or repaired any structure, equipment or system in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this Code, shall be liable for a civil penalty of not more than $1,000 for each such violation, plus costs including reasonable expert witness and attorney's fees incurred in bringing the action. Each day that a violation continues shall be deemed a separate violation."

Section 111, Means of Appeal, inclusive, shall be adopted in its entirety (Note: Subsections IPM-111.1 through IPM 111.8).

Insert Subsection 111.1.1 to read as follows:
111.1.1 Appeal from decision of Code Enforcement Officer. Any appeal from any decision of the Code Enforcement Officer shall be heard by the Upper Macungie Township Building Code Board of Appeals, pursuant to and consistent with the practices and procedures established for or by such Board.
E. 
Subsection 202, General Definitions.
CODE OFFICIAL. The official who is charged with the administration and enforcement of this code, or any duly authorized representative; the Code Enforcement Officer.
F. 
Chapter 3, General Requirements, Section IMP-304.0, Exterior Structure, Subsection IPM-304.14.
(1) 
Insert "April 1 to October 30" at the spaces indicated for "[DATE] to [DATE]".
G. 
Chapter 6, Mechanical and Electrical Requirements, Section IPM-602.0, Heating Facilities, Subsection IPM-602.2, Residential Buildings, Subsection 602.3, Heat Supply:

Insert "October 1 to April 30" for the spaces indicated "[DATE] TO [DATE]".
H. 
Chapter 6, Mechanical and Electrical Requirement, Section IPM-602.0 Heating Facilities, Subsection IPM-602.4, Occupiable Work Spaces:

Insert "October 1 to April 30" at the spaces indicated for "[DATE] to [DATE]".

1. 
Continuation. The provisions of this Chapter and of the code and Part hereby adopted, insofar as they are the same as those chapters, codes and/or parts in force immediately prior to the enactment of this Chapter, code and Part, are intended as a continuation of such chapters, codes and parts, and not as new enactments.
2. 
Saving. Nothing in this Part or in the International Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed by this Part; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Part.
3. 
Severability. If any provision of this Chapter, code or Part or the application thereof is held invalid, the invalidity shall not affect any other provisions or applications of this Chapter, code or Part, and the remaining provisions and applications shall be given full force and effect as completely as if the part or parts held invalid had not been included herein.[1]
