The definitions in NMSA 1978 § 60-3A-3, as now or
hereafter amended, apply to this chapter.
The sale or the possession for the purpose of sale, or offering
for sale, of alcoholic beverages is hereby prohibited in the City,
except upon the terms and conditions specified in this chapter.
It shall be unlawful for any person to drink or use any alcoholic
beverages of any kind, whether lawfully purchased or not, in any public
dance hall, pool room, bowling alley, or any public street or highway,
or in any other public place, excepting establishments having a license
to dispense alcoholic beverages.
It shall be unlawful for any person under the age of 21 years
to purchase, attempt to purchase or otherwise procure, consume or
have in his possession, or within a vehicle under his control, any
beer or other alcoholic beverages, unless accompanied by his parent
or legal guardian.

An intoxicated person who meets the requirements for protective
custody as set out within NMSA 1978 § 43-2-8 may be picked
up by police and taken to a holding facility, where they will be allowed
to stay until they wish to leave the facility.
