It shall be unlawful for any person to gather or collect within
the City of Putnam any refuse, rubbish, garbage or waste matter of
any kind, and/or to place, dump or deposit the same in or upon the
City Cemetery Landfill Refuse Disposal Area located on River Road
within the Town of Putnam, without first having secured a license
or permit.

A. Any person using the Town sanitary landfill area shall obtain a yearly
permit from the Town Clerk in accordance with the criteria below.
The use of said permit shall be in accordance with all other provisions
of this article and with such rules and regulations as may be prescribed
by the Board of Selectmen from time to time.
(1) Any property owner disposing of refuse by means of a private passenger
car or a truck, which refuse has been collected solely from his own
private residence, shall be required to obtain a residential permit.
All residential permits shall expire December 31 of each year. Residential
permits are not transferable to another property owner, but may be
redeemed at no additional cost for another residential permit upon
presentation of the voided permit to the Town.
(2) Commercially licensed vehicles with a rated capacity of more than 3/4 of a ton; or commercially licensed vehicles of 3/4 of a ton or less not falling under the residential permit criteria of Subsection
A(1) above shall obtain a commercial permit from the Town and pay, based on the weight of refuse disposed at the sanitary landfill area, a per-ton fee as may be set by the Board of Selectmen from time to time, but in no event less than $18 per ton. Commercial permits may be issued at any time but shall expire December 31 of each year. Commercial permits are not transferable and shall be displayed on all vehicles entering the Town sanitary landfill area. In the event the landfill scale becomes inoperable, the Selectmen may charge commercial permit holders a fee based on a scale outage charge policy adopted by the Selectmen, provided that the effect of such scale outage charge policy shall be to limit the charge to users of the landfill to no more than the current per-ton disposal rate specified in this subsection.
B. Billing and accounting. Charges for weighted commercially permitted
vehicles will be billed monthly and are due and payable within 30
days. Delinquent payments will be charged interest at the rate of
12% per year. Commercial permittees who are delinquent in the payment
of monthly bills for more than 60 days shall be suspended from all
disposal privileges until full payment is made.
C. Temporary use. Commercial permittees who shall be using the landfill
for two months or less shall be required to post either a surety bond
or cash bond in the amount of $10,000, or an amount equal to the estimated
tonnage charges for two months, whichever is less. Such deposit or
security may be applied toward the payment of solid waste disposal
bills.

D. Temporary suspension of residential permit requirements. For special
purposes, such as disposal of leaves, Christmas trees, or emergency
cleanups resulting from severe storms, the Mayor may suspend the requirement
that residential users of the landfill display permits. The Mayor
shall limit the length of time such suspension may be in effect and
may impose other reasonable rules and regulations governing the use
of the landfill during these times.
It shall be unlawful for any person to gather or collect within
the City of Putnam any inflammable matter and to burn, cause to burn,
or set fire to the same in and upon the City of Putnam sanitary land
fill refuse disposal area.
All permits issued to any person under the provisions of this
article may be revoked at any time by the Common Council upon approval
of the Sanitation Committee.
Every person, firm or corporation violating the provisions of
this article shall be deemed guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine not exceeding $100.

Notwithstanding any provisions of the foregoing or any other
Town ordinance, the disposition of residue in the residue facility,
as the same are defined in the certain ground lease dated November
15, 1993, between Wheelabrator Putnam, Inc. and the Town of Putnam,
is hereby declared to be permissible under Town ordinance and is hereby
authorized for a period coterminous with the term of said ground lease
as it may be extended; and any restriction as to the geographic origin
of materials to be deposited shall not apply to the proposed residue
facility.
